RESOLUTION: 7545-01 BY: Corrigan, FitzGerald, George, <br /> Roth, Seelie, Skindell, Smith. <br /> <br /> A RESOLUTION declaring it necessary to improve Forest Road (from <br />Lake Avenue to south end) by the complete reconstruction of the pavement <br />cross-section including the necessary installation and replacement of curbs, <br />aprons and sidewalks, together with all necessary appurtenances thereto and <br />tree laWn restoration. <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO; <br /> <br /> Section 1. That it is necessary to improve the following street in the City <br />of Lakewood: <br /> <br />Forest Road (from Lake Avenue to south end) <br /> <br /> Section 2. That said Forest Road (frOm Lake Avenue to south end) shall <br />be improved in accordance with specifications hereinafter referred to and now on <br />file in the office of the City Engineer including the complete reconStruction of the <br />pavement cross-section including the necessary installation and replacement of <br />curbs with ODOT Type 6 curbs, aprons and sidewalks, together with all <br />necessary appurtenances thereto and tree lawn restoration. <br /> <br /> Section 3. It is hereby determined and declared that said improvement is <br />conducive to the public health, convenience and .welfare of said City and the <br />inhabitants thereof. <br /> <br /> Section 4; That the plans, specifications and estimates of the proposed <br />improvements heretofore prepared and now on file in the office of the City <br />Engineer are hereby approved. <br /> <br /> SeCtion 5. Council hereby determines that the lots and lands abounding <br />and abutting upon the proposed improvements are specifically-benefited by said <br />improvements shall be assessed at a rate not to exceed $31.00 per foot of <br />frontage based upon an assessment rate of not greater than twenty (20) percent <br />of the cost of the 'project from back of sidewalk to centerline of street. Those lots <br />with side yards benefited by any of the said improvements shall be assessed an <br />amount equal to the average for all lots having frontage on the improved portion <br />of the street, plus an amount not to exceed $31.00 per foot for any lot depth in <br />excess of 150 feet. The assessments shall cover twenty (20) percent of the <br />actual cost of said improvement, less costs which are appropriately attributed to <br />other funds. Improvement costs include the cost of preliminary and other <br />surveys, publishing notices, resolutions and ordinances, the amount of damages <br />resulting from the improvement assessed in favor of any owner of land affected <br />by the improvement and the preparation, levy, and Collection of the special <br />assessments, the cost of purchasing appropriating, and otherwise acquiring <br />labor and material, interest on bonds and notes issued in anticipation of the levy <br />and collection of the special assessments together with all other necessary <br />expenditures. Such amount being hereby determined to be equal to the .special <br />benefit derived by lands so abounding and abutting these improvements. <br /> <br /> Section 6. That the Clerk of this Council be and she is hereby directed to <br />deliver a certified copy of this resolution to the Director of Finance of this City. <br /> <br /> Section 7. That pursuant to Section 3 of Article XVI of the Second <br />Amended Charter of the City of Lakewood, the Director of Finance of this City be <br />and is hereby authorized and directed to prepare and file with this Council the <br />estimated assessments of the cost of the improvement described in this <br />Resolution.
