RESOLUTION NO. 7562-01 <br /> <br />PLACED ON 1ST READING & REFERRED TO <br />PUBLIC WORKS COMMITTEE 5/7/01. <br />PLACED ON 2ND READING 5/21/01. <br /> <br /> BY: Corrigan, FitzGerald, George, <br /> Seelie, Skindell, Smith. <br /> <br />Roth, <br /> <br /> A RESOLUTION requesting the Cuyahoga County Engineer to proceed with the rehabilitation <br />of Lakewood Heights Boulevard (CR-297) from Woodward Avenue to Berea Road and Lakewood <br />Heights Boulevard Bridges No. 209 and 210 over the Cleveland Rapid Transit resolving to pay for the <br />increase in cost associated with the reconstruction of the pavement within the <br />Waterbury/Bramley/Lakewood Heights intersection. <br /> WHEREAS, the proposed improvement of Lakewood Heights Boulevard is being financed by <br />the Federal Government and Cuyahoga County; and <br /> WHEREAS, the Agreement between the Board of Cuyahoga County Commissioners and the <br />City of Lakewood states in Section H-l: "That if the COUNTY is formally requested by the <br />MUNICIPALITY through MuniciPal Resolution to include the .construction of sanitary sewers, <br />waterlines, area sewers (drainage of area surrounding the improvement), alternate bid items, or other <br />items in the improvement that are in addition to those now existing and not provided for elsewhere in <br />this agreement, the COUNTY will do so, provided that this construction meets with the approval of the <br />COUNTY and the MUNICIPALITY involved in this improvement; and that the MUNICIPALITY <br />agrees to pay, or make arrangements for the payment of, the cost of said additional construction and the <br />cost of preliminary and design engineering, but excluding conslraction supervision of said additional <br />work"; and <br /> WHEREAS, by. this resolution, the Cuyahoga County Engineer is formally requested to <br /> reconstruct the pavement within the Waterbury/Bramley/Lakewood Heights Boulevard intersection. <br /> BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1: That the Cuyahoga County Engineer is hereby requested to include the reconstruction <br /> of the pavement within the Waterbury, Bramley/Lakewood Heights Boulevard intersection. <br /> Section 2: The City of Lakewood agrees to assume the cost of any increase in expenses incurred <br /> by the Cuyahoga County Engineer for the reconstruction of the above-described intersection. <br /> Section 3: That this resolution is hereby declared to be an emergency measure necessary for the <br /> immediate preservation of the public peace, health and safety. Such necessity exists by reason of the <br /> fact that in order for plans for the improvement of Lakewood Heights Boulevard to be approved and said <br /> project bid, the reconstruction of the above-described intersection must be included in the project. <br /> Section 4: That the Mayor of the City of Lakewood is hereby empowered and directed on behalf <br /> of the MUNICIPALITY to enter into an agreement with the COUNTY necessary to complete the <br /> planning and construction of this improvement. <br /> Section 5: It is found and determined that all formal actions of this Council concerning and <br /> relating to the passage of this resolution were adopted in an open meeting of this Council and that all <br /> such deliberations of this Council and of any of its committees that resulted in such formal action were <br /> in meetings open to the pubic in compliance with all legal requirements, including Section 121.22 of the <br /> Ohio Revised Code. <br /> Section 6: That this Resolution shall take effect and be in force from and after the earliest period <br /> <br />allowed by law. <br />Adopted: ~ <br /> <br />Approved: <br /> <br /> <br />
