RESOLUTION NO. 7564-01 <br /> <br /> BY: Corrigan, FitzGerald, George, <br />Roth, Seelie, Skindell, Smith. <br /> <br />AN EMERGENCY RESOLUTION to accept and expend Cuyahoga' County <br />Brownfield Grant Funds, in the amount of Five Thousand Dollars ($5,000.00) for <br />· professional engineering services for an underground storage tank (UST) investigation <br /> at 11726-28 Detroit Avenue and :1385-87 Hird Avenue, Lakewood, Ohio. <br /> <br /> WHEREAS, the property located at 1:1726-28 Detroit Avenue and 1385-87 Hird <br />Avenue, Lakewood, Ohio has been on the market for nearly five (5) years; and <br /> <br /> WHEREAS, it is in the public interest to complete this study so that the sale.of <br />this property can be completed and the property be put to an economically viable and <br />tax generating use; and <br /> <br /> WHEREAS, the uncertainty of potenUal environmental hazards has played,a large <br />roll i~ discouraging the sale of said property to potential buyers; and <br /> <br /> WHEREAS, Cuyahoga County has Brownfield Grant Funds available to fund the <br />UST investigation of said property; and <br /> <br /> WHEREAS, this Coundl by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall <br />take effect at the eadiest date possible as set forth in ARTICLE III, SECTIONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the usual daily operation of municipal departments in that this project is <br />necessary to facilitate the sale of said properly for an economically viable and tax <br />generating use. Now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the Director of Plant{lng and Development is hereby <br />directed and authorized to accept and expend Cuyahoga County 8rownfield Grant <br />Funds, in the amount of Five Thousand Dollars ($5,000.00), for the purpose of <br />funding a UST investigation at the 0roperty located at 11726-28 Detroit Avenue <br />and 1385-87 Hird Avenue, Lakewood, Ohio. <br /> <br /> Section 2. Coundl hereby determines that the funding of said <br />Soil/Groundwater Sampling and Analysis with County Brownfield Grant Funds is <br />in the best interest of the public health, safety and welfare due to the possibility <br />that the property may have environmental contamination and to further the goal <br />of returning this property to an economically viable and tax generating use. <br /> <br /> Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resolution were adopted in an open <br />meeting of this Council, and thatall such deliberation of the Council and of any of its <br />committees thet'resulted in such formal action were in meetings open to ~he public in <br />compliance with all legal requirements. <br /> <br /> Section 4. This ordinance is hereby declared to be an emergency measure for the <br />providing for the usual daily operations of the City for the reasons set forth and defined <br />in the preamble to this ordinance, and provided it receives the affirmative .vote of at <br />least five (5) of its members elected to Council, this ordinance shall take effect and <br /> <br /> <br />
