RESOLU~ON NO.: 7618-02 BY: Corrigan, Dunn, FitzGerald, Georg~ <br /> Roth, Seelie, Skindell. <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Public Works to accept and <br />expend a $50,000 contribution of State funds from the Western Elmwood Berea Corporation for <br />the purpose of paying to Cuyahoga County a portion of the City of Lakewood's cost of <br />improvements at the West 117th Street/Madison Avenue intersection, as a portion of the local <br />share of the West 117th Street reconstruction project. <br /> <br /> WHEREAS, as authorized by Ordinance 83-87, the City of Lakewood entered into an <br />agreement with Cuyahoga County to pay a local share of the cost of reconstruction of West 117th <br />Street; and <br /> <br /> WHEREAS, Resolution 7435-99, authorized the Director of Public Works to expend <br />Community Development Block Grant funds to pay for a portion of the City's local share of the <br />reconstruction costs for West ll7th Street, and <br /> <br /> WHEREAS, Ordinance 52-99, authorized the Director of Public Works to bid and contract for <br />the design and construction of CDBG funded streets, including West ll7th Street, and <br /> <br /> WHEREAS, the Cities of Lakewood and Cleveland, in cooperation with the Western Elmwood <br />Berea Corporation (WEBCO), the Greater Cleveland Regional Transit Authority and the Cuyahoga <br />County Engineer' office, incorporated modifications to the West ll7th Street reconstruction project <br />to address pedestrian and vehicular safety, efficiency and other aesthetic and design <br />improvements to the West ll7th Street/Madison Avenue intersection; and <br /> <br /> WHEREAS, WEBCO received a $100,000 grant from the State of Ohio to be used for a <br />public capital improvement within the organization's service boundary; and <br /> <br /> WHEREAS, the West ll7th Street/Madison Avenue intersection is within WEBCO's service <br />boundary and the WEBCO membership voted to contribute the entire grant toward the cost of the <br />intersection improvements; and <br /> <br /> WHEREAS, the County requires that such funds be paid directly by the cities of Lakewood <br />and Cleveland which have agreements with the County related to the West 117th Street <br />reconstruction project; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto determines <br />that this resolution is an emergency measure, and that this resolution shall take effect at the <br />earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED <br />CHARTER OF THE CITY OF LAKEWOOD, and that immediate action is necessary in order to <br />expedite the receipt and expenditure of these State funds for this project. NOW, THEREFORE, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section I That the Public Works DireCtor is hereby authorized to accept and expend a <br />$50,000 contribution from WEBCO of State grant funds, to supplement the City's CDBG funds, for <br />the purpose of paying to Cuyahoga County a portion of the City of Lakewood's cost of <br />improvements at the West 117th Street/Madison Avenue intersection, as a portion of the local <br />share of the West 117th Street reconstruction project. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this Resolution were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and any of its committees that resulted in such formal <br />actions, were in meetings open to the public in compliance With all legal requirements. <br /> <br />Page 1 of 2 <br /> <br /> <br />
