REFERRED TO PUBLIC WORKS COMMITTEE 6/17/02. <br /> <br />RESOLUTION NO. 7678-02 BY: Corrigan, Dunn, FitzGerald, George, <br /> Roth, Seelie, Skindell. <br /> <br /> AN EMERGENCY RESOLUTION approving the payment to the westshore Council <br />of Governments and amount not to exceed $10,000 for the City of Lakewood's portion <br />of the repair of a Morbark Model 1100 Tub Grinder that was purchased jointly in 1991 <br />through the West. shore Council of Governments pursuant to Lakewood Codified <br />Ordinance §111.08. <br /> <br /> WHEREAS, in 1991 the City of Lakewood along with Bay Village, Fairview Park, <br />Rocky River and Westlake (the Participating Cities) entered into an Agreement for the <br />purchase and the maintenance of a tub grinder for yard waste disposal through of the <br />Westshore Council of Governments; and <br /> <br /> WHEREAS, pursuant to the Agreement, the City of Lakewood is responsible for <br />twenty percent (20%) of the maintenance costs for the equipment so long as it does <br />not withdraw from the Agreement; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall <br />take effect at the eadiest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that the Westshore <br />Council of Governments is currently bidding this repair out and will need to have <br />approval of member communities to enter into an agreement to have the repairs <br />performed; Now, therefore <br /> <br />BE 1-r RESOLVED BY THE CT~ OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That this Council hereby approves the payment to the Westshore <br />Council of Governments and amount not to exceed $10,000 for the City of Lakewood's <br />portion of the repair of a Morbark Model 1100 Tub Grinder that was purchased jointly in <br />1991 through the Westshore Council of Governments pursuant to Lakewood Codified <br />Ordinance §111.08. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />conceming and relating to the passage of this resolution were adopted in an open <br />meeting of this coundl, and that all such deliberations of this Council and any of its <br />committees that resulted in such formal action, were in meetings open to the public, in <br />compliance with all legal requirements. <br /> <br /> Section 3. That this resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property,. <br />health, safety and welfare in the City and for.the usual daily operation of the City for <br />the reasons set forth and defined in the preamble to this ordinance, and provided it <br />receives the affirmative vote of at least five (5) of its members elected to Council, this <br />resolution shall take effect and be in force immediately upon its adoption by the Council <br /> <br /> <br />
