PLACED ON 1ST READING & REFERRED TO THE <br />PUBLIC WORKS COMMITTEE 9/16/02. <br /> <br />RESOLUTZON NO. <br /> <br />7695'02 <br /> <br />Corrigan, Dunn, FitzGerald, George, <br />Roth, Seelie, Skindell. <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Mayor, for and on behalf of the <br />City, to seek financial assistance from the State Issue Two Infrastructure Bond Program <br />for funding of the 2003 Belle Avenue Rehabilitation Program. <br /> <br /> WHEREAS, pursuant to Article VIll of the Ohio Constitution, the State is <br />authorized to issue bonds and other obligations of the State of Ohio for the purpose of <br />flnandng public infrastructure capital improvements of political subdivisions as <br />designated by law; and <br /> <br /> WHEREAS, pursuant to Section 16~.06 of the Ohio Revised Code, the~District <br />One Public Works Integrating Committee is authorized to accept, evaluate and <br />recommend applications for state financing of capital Infrastructure improvement <br />projects of political subdivisions in Cuyahoga County; and <br /> <br /> WHEREAS, pursuant to Section 16~.05 of the Ohio Revised Code, the Director of <br />the Ohio Public Works Commission is authorized to accept and approve applications for <br />state financing of capital Infrastructure Improvement project of political subdivisions in <br />Cuyahoga County; and <br /> <br /> WHEREAS, the City of Lakewood has conducted a capital inventory and needs <br />assessment and has determined that it is necessary and desirable to apply for State <br />Issue Two Infrastructure Bond program funds for funding of the 2003 Belle Avenue <br />Rehabilitation Program; and <br /> <br /> WHEREAS, this Coundl by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and 'that this resolution shall <br />take effect at the eadlest date possible as set forth in ARTZCLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual dally operation of munidpai departments in that if this <br />application is not made in a timely manner, the C~3/will lose rcs opportunity to obtain <br />Issue Two Infrastructure Bond dollars. Now Therefore, <br /> <br />BE l'r RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHZO <br /> <br /> Section 1. That the Mayor, for and on behalf of the City, is hereby authorized <br />to apply to the District One Public Works [ntegrating Committee and the Director of the <br />Ohio Public Works Commission for financial assistance for the following capital <br />improvement projects: <br /> <br /> Belle Avenue Rehabilitation Program, Detroit Avenue to Lakewood Park <br /> <br /> Section 2. The Mayor, for and on behalf of the City, is further authorized to <br />enter into any agreements as may be necessa___ry and appropriate for obtaining such <br />funds; said agreements to contain such terms and conditions and be in such form as <br />the Director of Law deems necessary to protect the public Interest. <br /> <br /> <br />
