PLACED ON 1ST READING & REFERRED TO THE PUBLIC WORKS COMMITTEE 9/16/02. RESOLUTZON NO. 7695'02 Corrigan, Dunn, FitzGerald, George, Roth, Seelie, Skindell. AN EMERGENCY RESOLUTION authorizing the Mayor, for and on behalf of the City, to seek financial assistance from the State Issue Two Infrastructure Bond Program for funding of the 2003 Belle Avenue Rehabilitation Program. WHEREAS, pursuant to Article VIll of the Ohio Constitution, the State is authorized to issue bonds and other obligations of the State of Ohio for the purpose of flnandng public infrastructure capital improvements of political subdivisions as designated by law; and WHEREAS, pursuant to Section 16~.06 of the Ohio Revised Code, the~District One Public Works Integrating Committee is authorized to accept, evaluate and recommend applications for state financing of capital Infrastructure improvement projects of political subdivisions in Cuyahoga County; and WHEREAS, pursuant to Section 16~.05 of the Ohio Revised Code, the Director of the Ohio Public Works Commission is authorized to accept and approve applications for state financing of capital Infrastructure Improvement project of political subdivisions in Cuyahoga County; and WHEREAS, the City of Lakewood has conducted a capital inventory and needs assessment and has determined that it is necessary and desirable to apply for State Issue Two Infrastructure Bond program funds for funding of the 2003 Belle Avenue Rehabilitation Program; and WHEREAS, this Coundl by a vote of at least five (5) members elected thereto determines that this resolution is an emergency measure, and 'that this resolution shall take effect at the eadlest date possible as set forth in ARTZCLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual dally operation of munidpai departments in that if this application is not made in a timely manner, the C~3/will lose rcs opportunity to obtain Issue Two Infrastructure Bond dollars. Now Therefore, BE l'r RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHZO Section 1. That the Mayor, for and on behalf of the City, is hereby authorized to apply to the District One Public Works [ntegrating Committee and the Director of the Ohio Public Works Commission for financial assistance for the following capital improvement projects: Belle Avenue Rehabilitation Program, Detroit Avenue to Lakewood Park Section 2. The Mayor, for and on behalf of the City, is further authorized to enter into any agreements as may be necessa___ry and appropriate for obtaining such funds; said agreements to contain such terms and conditions and be in such form as the Director of Law deems necessary to protect the public Interest.
