RESOLUTION 'NO. <br /> <br />7772-03 <br /> <br />BY: Corrigan, Dever, Dunn, George, <br /> Roth: <br /> <br /> An EMERGENCY RESOLUTION authorizing the Mayor or her designee to file an application <br />to the State of Ohio, to participate in the Clean Ohio Revitalization Fund for the remediation of the <br />Hinkley Lighting, Inc. property located at 12750 Berea Road, Lakewood, Ohio. <br /> <br /> WHEREAS, the State of Ohio, Department of Development, provides financial assistance to <br />local governments for the purpose of addressing local needs; and <br /> <br /> WHEREAS, the Clean Ohio Revitalization Fund supports the cleanup of polluted properties <br />so that they can be rehabilitated for productive uses; and <br /> <br /> WHEREAS, the City of Lakewood, Ohio desires to participate in the Program 'to receive <br />financial assistance for the remediation of the Hinkley Lighting, Inc. property located at 12750 <br />Berea Road under the Clean Ohio Revitalization Fund; and <br /> <br /> WHEREAS, the City of Lakewood, Ohio has the authority to apply for financial assistance <br />and to administer the amounts received from the State of Ohio, Clean Ohio Council, Clean Ohio <br />Revitalization Fund; and <br /> <br /> WHEREAS, Ordinance 29-03 adopted April 7, 2003, authorized a Phase II Environmental <br />Assessment of the Hinkley Lighting, Inc. property located at 12750 Berea Road, Lakewood, Ohio <br />as a necessary component of the application to the State of Ohio, Clean Ohio Revitalization Fund; <br />and <br /> <br /> WHEREAS, the Mayor or her designee of the City of Lakewood, Ohio must direct and <br />authorize a contact person to act in connection with the application and to provide such additional <br />information as may be required. <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected hereto determines <br />that this Resolution is an emergency measure, and that this resolution shall take effect at the <br />earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED <br />CHARTER OF THE CITY OF LAKEWOOD, and that this is a necessary component to meet the <br />application deadline for the State of Ohio, Clean Ohio Revitalization Fund application. NOW <br />THEREFORE, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, COUNTY OF CUYAHOGA, STATE <br />OF OHIO: <br /> <br /> Section 1. That the Council of the City of Lakewood hereby approves filing an application <br />for financial assistance under the Clean Ohio Revitalization Fund. <br /> <br /> Section 2. The Council of the City of Lakewood hereby authorizes the Mayor or her <br />designee as the official representative for the City of Lakewood, Ohio application to participate in <br />the State of Ohio, Department of Development, and provide all information and documentation <br />required in said Application for. State of Ohio, Clean Ohio Council, Clean Ohio Revitalization Fund <br />submission for the remediation of the Hinkley Lighting, Inc. property located at 12750 Berea Road, <br />Lakewood, Ohio. <br /> <br /> Section 3. That the City of Lakewood hereby understands and agrees that participation in <br />the Program will require compliance with program guidelines and assurances. <br /> <br /> Section 4. That the City of Lakewood has provided Sixty Thousand Dollars {$60,000.00) <br />pursuant to Ordinance 29-03 adopted April 7, 2003 for the City's portion of the required match for <br />this program as described in the application. <br /> <br /> <br />
