REFERRED TO THE COMMITTEE OF THE WHOLE <br />72'7:/03. <br /> <br />RESOLUIION NO: 7779-03 BY: c..C,g!rigan, Dever, Dunn, FitzGerald, <br /> G~6rge, Roth, Seelie. <br /> <br /> AN EMERGENCY RESOLU-I'~ON authorizing the Mayor or her designee on behalf of the <br />Planning Commission to enter into an agreement in an amount not to exceed Twenty Thousand <br />Dollars ($20,000.00) to engage a consultant to provide professional planning services and provide <br />technical assistance related to the Zoning Code update. <br /> <br /> WHEREAS, pursuant to Subsection 1171.03(e) of the Zoning Code the Lakewood Planning <br />Commission periodically reviews and updates the Zoning Code; and <br /> <br /> WHEREAS, pursuant to the Development Agreement, executed on .lune 16, 2003, between <br />the City of Lakewood and Lakewood Shoppes LLC, the City is required to draft a new mixed-use <br />chapter for the Zoning Code and related design guidelines addressing the Shops at the West End <br />within the City of Lakewood; and <br /> <br /> WHEREAS, the Planning Commission desires to retain a consultant to supplement the staff <br />of the Department of Planning and Development by providing technical assistance to complete the <br />update of the Zoning Code in a timely fashion; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected hereto determines <br />that this Resolution is an emergency measure, and that this Resolution shall take effect at the <br />earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED <br />CHARTER OF THE Ci-I-Y OF LAKEWOOD, and is necessary to provide for the immediate <br />preservation of the public property, health and safety, and to allow the timely completion of the <br />Zoning Code update and the drafting of any related new regulations. NOW THEREFORE, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Council of the City of Lakewood hereby authorizes the Mayor or her <br />designee on behalf of the Planning Commission to enter into an agreement not to exceed Twenty <br />Thousand Dollars ($20,000.00) to engage a consultant to provide professional planning services <br />and to provide technical assistance related to the Zoning Code update. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this Resolution were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and any of its committees that resulted in such <br />formal actions, were in meetings open to the public in compliance with all legal requirements. <br /> <br /> Section 3. This Resolution is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City of <br />Lakewood and for the usual daily operation of the City for the reasons set forth and defined in the <br />preamble of this Resolution, and provided it receives the affirmative vote of at least five (5) of its <br />members elected to Council, this Resolution shall take effect and be in force immediately upon its <br />adoption by the Council and approval by the Mayor; otherwise it shall take effect and be in force <br />after the earliest period allowed by law. <br /> <br />Adopted: ~ ~/, ,~0~).~ <br /> , <br /> <br />Presidlnt <br /> <br />Approved: <br /> <br /> <br />
