Dunn. <br />FitzGerald, Madigan, Seelie. <br /> <br />AN EMERGENCY RESOLUTION authorizing and directing the Director of <br />Finance to sell, through trade-in, one (1) backhoe in conjunction with the purchase of a <br />2005 Model 310G Loader Extend hoe Backhoe. <br /> <br />WHEREAS, the City no longer needs the obsolete backhoe and it Is in the best <br />interest of the City to sell through trade-in this obsolete, backhoe and, <br /> <br />WHEREAS, this Council by an affirmative vote of at least five (5) ;members <br />el¢cted thereto determines that this ordinance is an emergency measure, and that this <br />ordinance shall take effect at the eariiest dáte possible as set forth in ARTiCLE III, <br />SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it provides for the usual daily operation of municipal departments <br />In ,.that it is in the best interest of the City to sell obsolete equipment due to lack of <br />physical storage at City Hall and delivery of new equipment, now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO' <br /> <br />Section 1. That the Director of Finance be and she is hereby authorized and <br />directed to sell, through trade-in, one (1) backhoe in conjunction with the purchase of <br />a2005 Model 310G Loader Extend hoe Backhoe <br /> <br />Section 2 It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this CounCil, and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action, were in meetings open to the public in <br />compliance with all [egal requirements. <br /> <br />Section 3 This ordinance is hereby declared to be an emergency measure <br />necessary for the daily operation of municipal departments in the City for the reasons set <br />forth in the preamble to this ordinance, and provided it received the affirmative vote of at <br />least five (5) of its members elected to Council, this ordinance shall take effect an'd be in <br />fo~ce immediately upon its adoption by the Council and approval by tl)e.
