SECOND <br />READING 6/6/05. <br />RESOLUTION NO. 7994-05 BY: Corrigan, Demro, Dèvef,," <br />FitzGerald, Seelie. <br />A RESOLUTION authorizing the Mayor to inform the Regional Inçome Tax <br />Agency (RITA) of the intention of the City of Lakewood to terminate agreement <br />to have RJTA act as agent for the City of Lakewood to administer and enforce <br />municipal inçome tax provisions of Ule City of Lakewood. <br /> <br />WHEREAS, pursuant to Ordinance 73-71, passed December 28, 1971, the <br />City of Lakewood hás entered into agreements with the Regional Income Tax <br />Agency, formed in connection with the Regional Council of Governments <br />authorized by Ordinance 34-71, to act as the City's agent in the administration, <br />coilection, and enforcement of the City's municipal income tax provisions; and <br /> <br />WHEREAS, the expenses and costs associated with the foregoing <br />agreements have become large enough to warrant consideration of bringing the <br />responsibiiities for such activities and collections "in-house"; and <br /> <br />WHEREAS, upon careful study by the Department of Finance, it has been <br />determined that bringing those activities and collections "in-house" is both <br />feasible and prudent, and the City desires to çommence such a change; and <br /> <br />WHEREAS, by terms of the City's current agreements with RITA, any <br />notification for terminating thòse agreements, to be effective for the calendar <br />year 2006, must be given no later than June 30, 2005; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this resolûtlon is an emergency measure, and that this <br />resolution shall take effect at the earliest date possible as set forth in ARTICLE <br />III, SEcrONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it is necessary for the immediate preservation of the public <br />property, health and safety, and to provide for the usual daily operation of <br />municipal departments in that the notification must be given to RITA no later <br />that June 30, 2005. Now Therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO. that <br /> <br />Section 1. Upon the effective date of this Resolution, the Mayor is <br />hereby authorized to serve notice to the Regional Income Tax Agency <br />terminating its agency for the City of Lakewood to administer and collect <br />municipal income taxes. <br /> <br />Section 2. Tllis resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, properly, <br />health, safety and welfare in the City and for the usual daily operation of the City <br />for the reasons set forth and defined in tile preamble to this resolution, and <br />provided it receives the affirmative vote of at least five (5) of its members <br />elected to Council, this resolution shall take effect and be in force immediately <br />upon Its adoption by the Council and approval by the i"layor otherwise, it shall <br />take effect and be in force after the earliest period allowed by law. <br /> <br />Q <br /> <br />Adopted: ~.
