RESOLUTION <br /> <br />8079-06 <br /> <br />~itzGerald, Ma~igan, Seeiie. <br /> <br /> AN EMERGENCY RESOLUTION authorizing and d'rectmg the Mayor, on behalf of the City, to <br />apply for financial assistance under the Northeast Ohio Area Wide Coordinating Agency's (NOACA) <br />Transportation for Livable Communities Initiative (TLCI) Planning Grant Program. <br /> <br /> WHEREAS, NOACA administers financial assistance provided by the U,S. Department of <br />Transportation's Federal Highway Administration, and; <br /> <br /> WHEREAS~ Hogsback La'ne Serves as a main access point into the Cleveland Metro Parks for <br />approximately 2,700 Lakewood households residing in the adjacent neighborhoods, and; <br /> <br /> WHEREAS, pedestrian access from the adjacent Lakew0od neighborhoods into the Cleveland <br />Metro Parks via Hogsback Lane is hazardous due to inadequate pedestrian facilities and traffic controls, <br />and; <br /> <br /> WHEREAS~ residents of the City of Lakewood would greatly benefit from further study of <br />public improvements necessary to enable pedestrian access to the Cleveland Metro Parks via Hogsback <br />Lane; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto determines <br />that this resolution is an emergency measure, and that this resolution shall take effec~ at the earliest date <br />possible as Set forth in ARTICLE III, SECTioNs 10 and 13 of the SECOND AMMENDED CHARTER OF THE <br />CItY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health, <br />and safety, and to provide for the usual daily operation of municipal departments, and that local legislative <br />approval for these funds must be received by NOACA no later than March 1, 2006. Now, therefore, <br /> <br /> BE IT oRDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section i; That the Mayor, on behalf of the City, be and is hereby authorized and directed <br />to e~ecute and file an application for Transportation for Livable Communities financial assistance with <br />NOACA and to provide all information and documentation required to become eligible for possible funding <br />assista rice. <br /> <br /> Section 2. That the City of Lakewood does agree to obligate the funds required to <br />satisfactod y complete the proposed project and become eligible for reimbursement under the terms and <br />conditions Of the Transpodcation for Livable Communities fund <br /> <br /> Section 3. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this resolution were adopted in an open meeting of this Council, and that afl such <br />deliberations bf this Council and of any of its committees that resulted in such formal action were in <br />meetings open to the public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an emergency measure necessary <br />for the usual daily operation of the City for the reasons set forth and defined in the preamble to this <br />ordinance, and provided it receives the affirmative vote of at least five (5} of its members elected to <br />Council, this resolution shall take effect and be in force immediately upon its adoption by the Council and <br />approval by the Mayor otherwise, it shall take effect and be in force after the earliest period allowed by <br />law. <br /> <br />Preslde~t of Councl <br /> <br />~lerk of Co~il <br /> <br /> <br />
