REFERRED TO THE PIIBLIC WORKS COMMITTEE 6/19/06 <br /> RESOLUTION N0. 8112-06 BY: Antonio, Butler, Demro, De~zer, <br /> FitzGerald, Madigan, Seelie <br /> A RESOLUTION to take effect Immediately provided it receives the affirmative <br /> vote of at least five (5) members elected to Council otherwise, it shall take effect and <br /> be in force after the earliest period allowed. by law, to adopt the Solid Waste <br /> Management Plan for the Cuyahoga County Solid Waste Management District. <br /> WHEREAS, the City of Lakewood is located within the jurisdiction of the <br /> Cuyahoga County Solid. Waste Management District (District); and <br /> WHEREAS, the Cuyahoga County Soiid Waste Management District Policy <br /> Committee prepared and adopted a final draft of the Soiid Waste Management Pian in <br /> accordance with. Ohio Revised Code Sections 3734.53, 3734.54 and 3734.55; and <br /> WHEREAS, the District provided a copy of the Draft Final Solid Waste <br /> Management Plan for ratification to each of the legislative authorities of the District; <br /> and <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br /> determines that this resolution is an emergency measure, and that this resolution shall <br /> take effect at the earliest date possible as set forth in ARTICLE III, SECTONS SO and <br /> 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br /> necessary for the immediate preservation of the public property, health and safety, and <br /> to provide for the usual daily operation of munkipal departments in that the City of <br /> Lakewood must decide whether it approves of said Solid Waste Management Plan <br /> within ninety {RO) days of the receipt of the Final Draft Plan. Now Therefore, <br /> BE 1T RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> Section 1. That the City of Lakewood hereby approves the Cuyahoga County <br /> Solid Waste Management Plan (a copy of which is on file and available for inspection in <br /> the Law Department). <br /> Section 2. That the Clerk is hereby directed to send a the District a copy of <br /> this resolution to the attention of Patrick J. Holland, Executive Director, Cuyahoga <br /> County Solid Waste District, 323 Lakeside Avenue West Suite 400, Cleveland, Ohio <br /> 44113. <br /> Section 2. It is found and determined that all formal actions of this Council <br /> concerning and relating to the passage of this resolution were adopted in an open <br /> meeting of this council, and that al! such deliberations of this Council and any of its <br /> committees. that resulted in such formal action, were in meetings open to the public, in <br /> compliance with all legal requirements. <br /> Section 3. That this resolution is hereby declared to be an emergency <br /> measure necessary for the immediate preservation of the public peace, property, <br /> health, safety and welfare in the City and for the usual dairy operation of the City for <br /> the reasons set forth and defined in the preamble to this reso[ution, and provided it <br /> receives the affirmative vote of at least five (5) of its members elected to Council, this <br /> resolution shall take effect and be in force immediately upon its adoption by the Council <br /> and approval by the Mayor otherwise, it shall take effect and be in force after the <br /> earliest period allowed by law. ~o <br /> Adopted: 3 do a~"`N z <br /> President <br /> av~ <br /> Clerk <br /> <br /> Approved: 3 6 <br /> Mayor <br /> <br />
