RESOLUTION N0. 8117-06 BY: Antonio, Butler, Demro; Dever, <br /> FitzGerald, Madigan, Seelie. <br /> A RESOLUTION to take effect immediately provided it receives the <br /> affirmative vote of at least five (5) members elected to Council otherwise, it shall <br /> take effect and be in force after the earliest period allowed by law, authorizing the <br /> Mayor to accept, on behalf of the City of Lakewood, five (5) benches for the <br /> Promenade at Lakewood Park from F. Buddie Contracting, Ltd valued at over <br /> $6,000. <br /> WHEREAS, Mike Buddie, ownerof F. Buddie Contracting, Ltd. has <br /> expressed a desire to donate five (S) benches that have been placed at the <br /> Promenade at Lakewood Park; and <br /> WHEREAS, Mike Buddie wishes to dedicate one of the benches to the <br /> memory Jerry Becker, along-time family friend and resident of the City of <br /> Lakewood;and <br /> I <br /> WHEREAS, this Council by a vote of at (east five (5) members elected <br /> thereto determines that this resolution is an emergency measure, and that this <br /> resolution shall take effect at the earliest date possible as set forth in ARTICLE III, <br /> SECTONS SO and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br /> LAKEWOOD, and that it is necessary for the immediate preservation of the public <br /> property, health and safety, ahd to provide for the usual daily operation of <br /> municipal departments ih that these benches have already been placed at <br /> Lakewood. Park but have not been formally accepted as a donation. Now, <br /> therefore, <br /> BE IT RESOLVED BY THE CFR' OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Mayor is hereby authorized to accept, on behalf of <br /> the City of Lakewood, five (S) benches for the Promenade at Lakewood Park from <br /> F. Buddie Contracting, Ltd valued at over $6,000. <br /> Section 2, It is found and determined that all format actions of this <br /> Council concerning and relating to the passage of this ordinance were adopted in <br /> an open meetlng of this Council, and that all such deliberations of this Council and <br /> of any of its committees that resulted in such formal actions were in meetings <br /> open to the public, in compliance with all legal requirements. <br /> Section 3. That this resolution is hereby declared to be an emergency <br /> measure necessary for the. immediate preservation of the public peace,: property, <br /> ftealth, safety and welfare in the City and for the usual daily operation of the City <br /> for the reasdns set forth and defined in the preamble to this resolution, and <br /> provided it receives the affirmative vote of at least five (S) of its members elected <br /> <br /> to Council, this resolution shall take effect and be in force immediately upon its <br /> adoption by the Council and approval by the Mayor otherwise, it shall take effect <br /> and be in force after the earliest period allowed by law. <br /> Adopted: ~~~~,Qa.~4_/_-wb <br /> Q President <br /> Jerk <br /> <br /> Approved:(~~~ ! ~,~6 <br /> Mayor <br /> <br />
