RESOLUTION NO. 8137-06 BY~ Antonio, Butler, Demro, Dever, FitzGerald, Madigan. A RESOLUTION to take effect immediately provided it received the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law authorizing the Mayor, for and on behalf of the City, to seek fmancial assistance from the Ohio Public Work Commission for funding of the Clifton Boulevard Watermain Project. WHEREASy pursuant to Article VIII of the Ohio Constitution, the State is authorized to issue bonds and other obligations of the State of Ohio for the purpose of financing public infrastmcture capital improvements of political subdivisions as designated by law; and WHEREAS, pursuant to Section 164.06 of the Ohio Revised Code, the District One Public Works Integrating Committee is authorized to accept, evaluate and recommend applications for state financing of capital infrastructure improvement projects of political subdivisions in Cuyahoga Count}; and WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Director of the Ohio Public Works Commission is authorized to accept and approve applicafions for state financing of capital infrastructure improvement project of political subdivisions in Cuyahoga County; and WHEREAS, the City of Lakewood has conducted a capital inventory and needs assessment and has determined that it is necessary and desirable to apply for Ohio Public Works Conunission grant funds for funding of the Clifton Boulevard Watemrain Project; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, I and to provide for the usual daily operation of municipal departments in that if this application is not made in a timely mannei, the City will lose its opportunity to obtain Ohio Public Works Commission grant dollars. Now Therefore, BE IT RESOLVED BY THE CTTY OF LAKEWOOD, STATE OF OHIO Section 1. That the Mayor, for and on behalf of the City, is hereby authorized to apply to the District One Public Works Integrating Committee and the Director of the Ohio Public Works Commission for financial assistance for the following capital improvement projects: Clifton Boulevard Watermain Project Section 2. The Mayor, for and on behalf of the City, is further authorized to enter into any agreements as maybe necessary and appropriate for obtaining such funds; said ageements to contain such terms and conditions and be in such form as the Director of Law deems necessary to protect the public interest. Section 3 It is found and detemmned that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this council, and that all such deliberations of this Council and any of its committees that resulted in such formal acfion, were in meetings open to the public, in compliance with all legal requirements Section 4..
