RESOLUTION NO. 8207-07 BY: Antonio, Butler, Demro, Dever, FitzGerald, Madigan, Seelie. A RESOLUTION to take effect immediately provided it receives the vote of at least five (5) members elected to Councii otherwise, it shall take effect and be in force after the earliest period allowed by law authorizing the Mayor, for and on behalf of the City, to seek financiai assistance from the Ohio Public Works Commission for funding of the Bunts Road Construction Project. WHEREAS, pursuant to Article VIII of the Ohio Constitution, the State is authorized to issue bonds and other obligations of the State of Ohio for the purpose of financing public infrastructure capital improvements of political subdivisions as designated by iaw; and WHEREAS, pursuant to Section 164.06 of the Ohio Revised Code, the District One Public Works integrating Committee is authorized to accept, evaiuate and recommend applications s for state financing of capital infrastructure improvement projects of political subdivisions in Cuyahoga County; and - WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Director of the Ohio Public Works Commission is authorized to accept and approve applications for state financing of capitai infrastructure improvement project of political subdivisions in Cuyahoga County; and WHEREAS, the City of Lakewood has conducted a capital inventory and needs assessment and has determined that it is necessary and desirable to apply for Ohio Public Works Commission grant funds for funding of the Bunts Road Construction Project; and WHEREAS, this Councii by a vote of at least five (5) members eiected thereto determines that this resoiution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ARTICLE III, SECfONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daiiy operation of municipal departments in that victims of this hurricane need immediate assistance, Now Therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1, That the Mayor, for and on behaif of the City, is further authòrized to apply to the District One Public Works Integrating Committee and the Director of the Ohio Public Works Commission for financial assistance for the following capital improvement projects: Bunts Road Construction Project Section 2, The Mayor, for and on behalf of the City, is further authorized to enter into any agreements as may be necessary and appropriate for obtaining such funds; said agreements to contain such terms and conditions and be in such form as the Director of Law deems necessary to protect the public interest. Section 3. It is found and determined that a.ll formal actions of this Councii concerning and relating to the passage of this resolution were adopted in an open meeting of this Councii, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with alllegai requirements.
