<br />A RESOLUTION to take effect immediately provided it receives the affirmafive vote of at least
<br />five (5) members elected to Council otherwise, it shall take effect and be in force at the earliest period
<br />allowed by law withdrawing the objection of Council to the transfer of ownership of Cl, C2 liquor permits
<br />from YLLI & ALMA RECKA d/b/a Europe Mart, 16503 Detroit Road, Lakewood, Ohio to ARD
<br />Enterprises Inc d/b/a Hot Spot Food Mart, 16403 Detroit Road, Lakewood, Ohio.
<br />WHEREAS, pursuant to the motion made at the November 17, 2008, Council Meeting, this
<br />Council objected to the transfer of ownership of Cl and C2 liquor permits from YLLI & ALMA RECKA
<br />d/b/a Europe Mart, 16503 Detroit Road, Lakewood, Ohio to ARD Enterprises Inc d/b/a Hot Spot Food
<br />Mart„ 16403 Detroit Road, Lakewood, Ohio -Transaction & Number as identified on the Notice to
<br />Legislative Authority as C TRFO 0258195, and
<br />WHEREAS, said permit holders have indicated a wIllingness to cooperate in enforcing. the liquor
<br />laws, and have provided documentation as to the names of present stockholders, and
<br />WHEREAS, under these circumstances and in consideration thereof, this Council deems it
<br />appropriate to withdraw the objection to the Transfer ofownership, and
<br />WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this resolution
<br />is an emergency measure, and that this resolution shall take effect at the eazliest date possible as set forth in ARTICLE
<br />III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is
<br />necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily
<br />operation of municipal departments in that [his equipment should be made available for use by the Division of Police
<br />immediately, now, therefore,
<br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO.
<br />Section 1. That in consideration of the documentation provided, the Council hereby withdraws its
<br />previously stated objection to the transfer of ownership from YLLI & ALMA RECKA d/b/a Europe Mart,
<br />16503 Detroit Road, Lakewood, Ohio to ARD Enterprises Inc d/b/a Hot Spot Food Mart, 16403 Detroit
<br />Road, Lakewood, Ohio.
<br />Section 2 . It is found and determined that all formal actions of this Council concerning and
<br />relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such
<br />deliberations of this Council and of any of its committees that resulted in such formal actions were in
<br />meefings open to the public, in compliance with all legal requirements.
<br />Secflon 3 That this resolution is hereby declazed to be an emergency measure necessary for the immediate
<br />preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the
<br />City for the reasons set forth and defined iti the preamble to this resolution, and provided it receives the affirmative
<br />vote of at least five (5) of its members elected to Council, this resolution shall take effect and be in force immediately
<br />upon its adoption by the Council and approval by the Mayor otherwise, it shall take effect and be in farce after the
<br />earliest period allowed by law.
