RESOLUTION NO.. 8335-09 BY: Antonio, Bullock, Butler, Dever, Madigan, Powers, Summers. A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Councii otherwise, it shall take effect and be in force after the earliest period allowed by law authorizing the City of Lakewood to execute and file an application with the Ohio Department of Natural resources for financial assistance through the Land and Water Conservation Fund (LWCF) Program. WHEREAS, the State of Ohio, through the Department of Natural Resources, administers financial assistance for public recreation purposes through the federally-funded Land and Water Conservation Fund Program; and WHEREAS, the City of Lakewood desires financial assistance under the Land and Water Conservation Fund Program; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of public property, health and safety, and to provide for the usual daily operation of municipal departments in that applications for assistance through the Land and Water Conservation Fund Program are due no later than April 1, 2009. Now Therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Council of the City of Lakewood approves filing an application for financial assistance. Section 2. That the Director of Public Works is hereby authorized and directed to execute and file an application with the Ohio Department of Natural Resources and to provide all information and documentation required to become eligible for possible funding assistance. Section 3. That the City of Lakewood does agree to obligate the funds required to satisfactorily complete the proposed project and become eligible for reimbursement under the terms of the Land and Water Conservation Fund Program.
