RESOLUTION N0. 8349-09 BY: Antonio, Bullock, Butler, Dever, <br />Madigan, Powers, Summers. <br />A RESOLUTION to take effect immediately provided it receives the affirmative <br />vote of a least five (5) members elected to Council otherwise, it shall take effect and go <br />into force after the earliest period allowed by law, withdrawing the objection to the <br />issuance of new Cl and C2 liquor permits to Lakewood Supermarket, LLC for an <br />establishment located at .14235 Madison Avenue, City of Lakewood, Ohio 44107. <br />WHEREAS,. pursuant to the motion made at the November 3, 2008 Council <br />meeting, this Council objected to the issuance of new Cl and C2 liquor permits to <br />Lakewood Supermarket, LLC, 14235 Madison Avenue, Lakewood, Ohio -Transaction <br />and Permit Number 4985430 as identified in the Notice to Legislative Authority; and <br />WHEREAS, after further review of the circumstances that gave rise to the basis <br />for the objection, Council has been reassured that there is no reason to continue its <br />objection; and <br />WHEREAS, under these circumstances and in consideration thereof, this Council <br />deems it appropriate to withdraw the objection to the liquor permit application; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the usual daily operation of municipal departments in that the applicant <br />should not be delayed from moving forward with the application for new permits. Now <br />therefore, <br />BE 1T RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: <br />Section 1. That the Council hereby withdraws its previously entered objection <br />to the issuance of new Cl and C2 liquor permits to Lakewood Supermarket, LLC, 14235 <br />Madison Avenue, Lakewood, Ohio. <br />Section 2. That the Clerk of Council is hereby authorized and directed to <br />forward a certified copy of this Resolution to the Department of Liquor Control, State of <br />Ohio, Permit Division, forthwith. <br />
