Section 3. Upon completion of the described Project, and unless otherwise <br />agreed, the City of Lakewood shall: (1) provide adequate maintenance for the <br />described Project in accordance with all applicable stat and federal laws, <br />including, but not limited to 23 USC 116; (2) provide ample financial provisions, <br />as necessary for the maintenance of the described Project; (3) if necessary, <br />maintain the right-of-way, keeping it free of obstructions; and (4) if necessary, <br />hold said right-of-way inviolate for public highway purposes. <br />Section 4. If the application is approved for the funding, the Director of <br />Public Works is hereby empowered on behalf of the City of Lakewood to enter <br />into a contract with the Director of the Ohio Department of Transportation <br />necessary to complete the above described project. <br />Section 5. It is found and determined that ail formal actions of this Council <br />concerning and. relating to the passage of this resolution were adopted in an <br />open meeting of this Council, and that all such deliberations of this Council and <br />any of its committees that resulted in such formal action, were in meeting open <br />to the public in compliance with all legal requirements. <br />Section 6. That this Resolution is hereby declared to be an emergency <br />measure necessary for the usual daily operation of City for the reasons set forth <br />in the preamble to this Resolution, and provided it receives the affirmative vote <br />of at least five of its members elected to Council, this Resolution shall take effect <br />and be in force immediately upon its adoption by the Council and approval by <br />the Mayor otherwise, it shall take effect and. be in force after the earliest period <br />allowed by law. <br />Adopted: ~~,~'~ (q ~Z~ l~ <br />Approved: ljj~a~ l~°f <br />~~~~~ <br />President of Council <br />~• ~~~ ~~ <br />Clerk f Council <br />~ ,iQ <br />Mayor <br /> <br />
