Amended on the floor 11/16/09 RESOLUTION NO. 8380-09 BY: Bullock, Butler, Dever, Madigan, Powers, Summers A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shalltake effect and be in force after the earliest period allowed by law authorizing the Mayor s to apply for, accept and. enter into a Water Pollution Control Loan Fund Full Principal Forgiveness Assistance Agreement on behalf of the City of Lakewood for planning, design ahd/or construction of Waster Water Treatment Facilities Improvements with the Environmental Protection Agency of the State of Ohio in an amount estimated at $652,500. WHEREAS, the City of Lakewood seeks to upgrade its existing wastewater treatment facilities; and WHEREAS, the City of Lakewood intends to apply for Water Pollutioh Control Loan Fund for the planning, design, and/or construction of the wastewater facilities improvements; and WHEREAS, the Ohio Water Pollution Control Loan fund requires the government authority to pass legislation for application of a loan and the execution of an agreement; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of public property, health and safety, and to provide for the usual daily operation of municipal departments in that applications for this program are currently being accepted and are under consideration. Now Therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor is hereby authorized to apply for, accept and enter ihto a Water Pollution Control Loan Fund Full Principal Forgiveness Assistance Agreement on behalf of the City of Lakewood for planning, design and/or construction of Waster Water Treatment Facilities Improvements with the Environmental Protection Agency of the State of Ohio in an amount estimated at $652,500.
