RESOLUTION NO. 8418-10 BYt Antonio, Bullock, Butler, Madigan, Powers, Smith, Summers. A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and go into force after the earliest period allowed by law, withdrawing the objection to the transfer of ownership of D2, D2X, D3A and D6 liquor permits from Jay RRS Inc. to 14027 Madison Avenue LLC dba Richland Cafe located at 14027 Madison Avenue, City of Lakewood, Ohio 44107. WHEREAS, pursuant to the motion made at the December 21, 2009 Council meeting, this Council objected to the transfer of ownership of D2, D2X, D3A and D6 liquor permits from Jay RRS Inc. to 14027 Madison Avenue LLC dba Richland Cafe based upon the results of the investigation conducted by the Lakewood Police Department as set forth in Resolution No. 8382- 09; and WHEREAS, after further review of the circumstances that gave rise to the basis for the objection, and a resulting legally binding agreement that was entered into by the new owners of the Richland Cafe that specifically addresses the City's prior concerns, Council is satisfied that the appropriate steps have been taken to ensure compliance with the applicable laws; and WHEREAS, under these circumstances and in consideration thereof, this Council deems it appropriate to withdraw the objection to the liquor permit application; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the usual daily operation of municipal departments in that the applicant should not be delayed from moving forward with the application for new permits. Now therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Council hereby withdraws it's previously entered objection to the transfer of ownership of D2, D2X, D3A and D6 liquor permits from Jay RRS Inc. to 14027 Madison Avenue LLC dba Richland Cafe located at 14027 Madison Avenue, City of Lakewood, Ohio 44107. Section 2. That the Clerk of Council is hereby authorized and directed to forward a certified copy of this Resolution to the Department of Liquor Control, State of Ohio, Permit Division, forthwith.
