RESOLUTION N0. 8421-10 By: Antonio, Bullock, Butler, <br />Madigan, Powers, Smith, Summers <br />A RESOLUTION to take effect immediately provided it receives the <br />affirmative vote of at least five (5) members elected to Council otherwise, it shall <br />take effect and be in force after the earliest period allowed by law, authorizing <br />an offer to pick-up all or part of the voluntary contributions through a payroll <br />deduction for the purchase of service credit by employees of the Division of <br />Policewho are members of the Ohio Police and Fire Pension Fund. <br />WHEREAS, the eligible employees of the Lakewood Police Department <br />participate in the Ohio Police and .Fire Pension Fund (OP&F); and <br />WHEREAS, this Council desires to offer spick-up for the voluntary <br />purchase of service credit, as provided for in Section 742.32 of the Ohio Revised <br />Code and Section 742-7-14 of the Ohio Administrative Code; and <br />WHEREAS, OP&F has adopted procedures for reporting picked up <br />contributions in order to properly prepare 1099-R forms for its members <br />pursuant to Section 742.32 of the Ohio Revised Code and Section 742-7-14 of <br />the Ohio Administrative Code; and <br />WHEREAS, employers may pay all or a part of the voluntary contributions <br />for the purchase of service credit for employees participating in the OP&F; and <br />WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this resolution is an emergency measure, and that this <br />resolution shall take effect at the earliest date possible as set forth in ARTICLE <br />III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it is necessary for the immediate preservation of the public <br />property, health and safety, and to provide for the usual daily operation of <br />municipal departments in that it is necessary to be in compliance with an IRS <br />ruling that requires employers to provide written documentation of pick-up plans. <br />Now Therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1: That this Council has determined to offer to pick-up all or a <br />portion of the voluntary contributions through a payroll deduction for the <br />purchase of service credit by employees who are members of the OP&F and who <br />are members of Western Cuyahoga Lodge No. 25, Fraternal Order of Police, <br />
