Antonio, Bullock, Butler, Madigan, <br />RESOLUTION N0. 8439-10 BY: powers, Smith, Summers. <br />A RESOLUTION to take effect immediately provided it receives the vote of at <br />least five (5) members elected to Council otherwise, it shall take effect and be in force <br />after the earliest period allowed by law authorizing the Mayor, for and on behalf of the <br />City, to seek financial assistance from the Ohio Public Works Commission for funding of <br />the Madison Avenue Improvement Project. <br />WHEREAS, pursuant to Article VIII of the Ohio Constitution, the State is <br />authorized to issue bonds and other obligations of the State of Ohio for the purpose of <br />financing public infrastructure capital improvements of political subdivisions as <br />designated by law; and <br />WHEREAS, pursuant to Section 164.06 of the Ohio Revised Code, the District <br />One Public Works integrating Committee is a~.:thorized to accept, eval!~ate and <br />recommend applications s for state financing. of capital infrastructure improvement <br />projects of political subdivisions in Cuyahoga County; and <br />WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Director of <br />the Ohio Public Works Commission is authorized to accept and approve applications for <br />state financing of capital infrastructure improvement project of political subdivisions in <br />Cuyahoga County; and <br />WHEREAS, the City of Lakewood has conducted a capital inventory and needs <br />assessment and has determined that it is necessary and desirable to apply for Ohio <br />Public Works Commission grant funds for funding of the Madison Avenue Improvement <br />Project; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that applications for <br />financial assistance must be made to the Ohio Public Works Commission no later than <br />September 17, 2010. Now Therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1.
