Amended on the floor 11/15/lm <br />RESOLUTION NO. 8454-10 BY: Bullock, Butler, Madigan, <br />Powers, Smith. <br />A RESOLUTION to identify a prospective appointee to the office of Mayor of the <br />City of Lakewood in the event that office becomes vacant on or about January 1, 2011. <br />WHEREAS, by virtue of the November 2, 2010 election of Mayor Edward <br />FitzGerald to the office of Cuyahoga County Executive, the Mayor's office is likely to <br />become vacant on or about January 1, 2011; and <br />WHEREAS, Article II, Section 8 of the Second Amended Charter provides that <br />"[i]f the Mayor's office becomes vacant, the following individuals shall succeed to the <br />office in the following order: Director of Law, Director of Finance, Director of Public <br />Works, President of Council, and an elector of the City chosen by Council"; and <br />WHEREAS, Council has received written notification from the Director of Law, <br />Director of Finance, Director of Public Works and President of Council declining to <br />succeed to the Mayor's office in the event that office becomes vacant on or about January <br />1, 2011; and <br />WHEREAS, it has thus become incumbent upon Council to identify a prospective <br />appointee to the Mayor's office in the event the vacancy occurs and those in the line of <br />succession formally decline to succeed to the office after the vacancy occurs; and <br />WHEREAS, having received and reviewed application materials sought from <br />qualified electors of the City interested in seeking Council's appointment to the Mayor's <br />office, Council now desires to identify its prospective appointee in order to ensure a <br />thorough and successful mayoral transition; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. This Council hereby identifies M; ,.h a a i p _ s„mm ~ , an <br />elector of the City, as its prospective appointee to the office of Mayor pursuant to Article <br />II, Section 8 of the. Second Amended Charter, provided the Mayor's office becomes <br />vacant as a result of Mayor Edward FitzGerald's election as Cuyahoga County Executive, <br />and in the event those in the line of succession formally decline to succeed to the Mayor's <br />office after the vacancy occurs. <br />Section 2. This Council, having identified its prospective appointee, hereby <br />pledges its commitment to appoint such person to the Mayor's office upon a vacancy <br />occurring on or about Januazy 1, 2011, provided those. in the charter line of succession <br />formally decline to succeed to the office at that time. <br />Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resolution were adopted in an open meeting <br />of this Council, and that all such deliberations of this Council and of any of its <br />
