RESOLUTION NO. $471-10 BZ,: Bullock, Butler, Madigan, Powers, Smith. A RESOLUTION to identify Ryan P. Nowlin as its prospective appointee to the office of at-large councilperson of the City of Lakewood in the event that office becomes vacant on or about January 1, 2011. WHEREAS, by virtue of the November 2, 2010 election of Councilwoman Vickie J. Antonio to the office of state assemblyperson, the office of at-large councilperson is likely to become vacant on or about January 1, 2011; and WHEREAS, Article III, Section 2 of the Second Amended Charter provides that "[v]acancies in Council shall be filled by the remaining members thereof, provided that in the event Council does not so appoint a successor within sixty (60) days of the occurrence of a vacancy, the Mayor may fill the vacancy"; and WHEREAS, it has thus become incumbent upon Council to identify a prospective appointee to the at-large Council office currently held by Councilwoman Antonio in the eventthe vacancy occurs; and WHEREAS, having received and reviewed application materials sought from qualified electors of the City interested in seeking Council's appointment as at-large councilperson, Council now desires to identify .its prospective appointee in order "to ensure a thorough and successful transition; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. This Council hereby identifies Ryan P. Nowlin, an elector of the City, as its prospective appointee to the office of at-large councilperson pursuant to Article III, Section 2 of the Second Amended Charter, provided that office becomes vacant as a result of Councilwoman Vickie J. Antonio's election to the. Ohio House of Representatives. Section 2: This Council, having identified its prospective appointee, hereby pledges its commitment to appoint such person to the office of at-large councilperson upon a vacancy occurring on or about January 1, 2011. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
