RESOLUTION NO. 8501-11 BY~Anderson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force at the earliest period <br />allowed by law, authorizing the Director of Public Works to contract with Neptune Equipment <br />Company for the trade-in of obsolete meter-reading equipment in exchange fora $9,000.00 credit <br />on the price for replacing that equipment. <br />WHEREAS, the City has contracted with Neptune Equipment Company to provide its <br />water meters and water meter reading equipment; and <br />WHEREAS, Neptune Equipment Company has offered a credit to the City in the amount <br />of $9,000.00 for the trade-in of six obsolete meter readers from the price of replacement meter <br />readers; and <br />WHEREAS, Council adopted Ordinance 20-11, effective May 19, 2011, permitting trade- <br />in of equipment valued at $5,000.00 or less, recognizing that "it is in the best interest of the City <br />to sell through trade-in various obsolete vehicles, machinery and/or equipment to apply toward <br />purchase costs of new vehicles, machinery and/or equipment"; and <br />WHEREAS, the aspirations of Ordinance 20-11 still apply in this instance despite the <br />equipment's value exceeding the maximum threshold of trade-ins allowed under that ordinance; <br />and <br />WHEREAS, all departmental contracts not specifically excepted by ordinance must be <br />approved by Council pursuant to Section 111.02 of the Codified Ordinances; and <br />WHEREAS, this Council by a vote of at least five members thereof determines that this <br />resolution is an emergency measure, that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, <br />and that it is necessary for the immediate preservation of the public peace, property,. health, safety <br />and welfare and to provide for the usual daily operation of municipal departments in that permit- <br />ting the trade-in of this equipment will permit the City to finalize an outstanding balance under <br />the contract with Neptune Equipment Company; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. The Director of Public Works is hereby authorized to contract with Nep- <br />tune Equipment Company for the trade-in of six obsolete water meter readers in exchange for a <br />$9,000.00 credit on the price for replacing that equipment. <br />
