RESOLUTlONNO. 8524-11 BY: Anderson, Bullock, Juris, Nowlin, Powers, Smith. A RESOLUTION to take effect immediately provided it receives the vote of at least five (5) members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, authorizing the Mayor, for and on behalf of the City, to seek financial assistance from the Ohio Public Works Commission for funding of the Madison Avenue Improvement Project. WHEREAS, pursuant to Article VIII of the Ohio Constitution, the State is authorized to issue bonds and other obligations of the State of Ohio for the purpose of financing public infrastructure capital improvements of political subdivisions as designated by law; and WHEREAS, pursuant to Section 164.06 of the Ohio Revised Code, the District One Public Works Integrating Committee is authorized to accept, evaluate and recommend applications s for state financing of capital infrastructure improvement projects of political subdivisions in Cuyahoga County; and WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Director of the Ohio Public Works Commission is authorized to accept and approve applications for state financing of capital infrastructure improvement projects of political subdivisions in Cuyahoga County; and WHEREAS, the City of Lakewood has conducted a capital inventory and needs assessment and has determined that it is necessary and desirable to apply for Ohio Public Works Commission grant funds for funding of the Madison Avenue Improvement Project; and WHEREAS, this Council by a vote of at least five (5) members thereof determines that this resolution is an emergency measure, and that it shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that applications for financial assistance must be made to the Ohio Public Works Commission no later than September 30, 2011; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor, for and on behalf of the City, is authorized to apply to the District One Public Works Integratnng Committee and the Director of the Ohio Public Works Commission for financial assistance for the following capital improvement project(s): Madison Avenue Improvement Project
