RESOLUTlONNO. 8524-11 BY: Anderson, Bullock, Juris, <br />Nowlin, Powers, Smith. <br />A RESOLUTION to take effect immediately provided it receives the vote of at least five (5) <br />members of Council, or otherwise to take effect and be in force after the earliest period allowed by <br />law, authorizing the Mayor, for and on behalf of the City, to seek financial assistance from the Ohio <br />Public Works Commission for funding of the Madison Avenue Improvement Project. <br />WHEREAS, pursuant to Article VIII of the Ohio Constitution, the State is authorized to <br />issue bonds and other obligations of the State of Ohio for the purpose of financing public <br />infrastructure capital improvements of political subdivisions as designated by law; and <br />WHEREAS, pursuant to Section 164.06 of the Ohio Revised Code, the District One Public <br />Works Integrating Committee is authorized to accept, evaluate and recommend applications s for <br />state financing of capital infrastructure improvement projects of political subdivisions in Cuyahoga <br />County; and <br />WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Director of the Ohio <br />Public Works Commission is authorized to accept and approve applications for state financing of <br />capital infrastructure improvement projects of political subdivisions in Cuyahoga County; and <br />WHEREAS, the City of Lakewood has conducted a capital inventory and needs assessment <br />and has determined that it is necessary and desirable to apply for Ohio Public Works Commission <br />grant funds for funding of the Madison Avenue Improvement Project; and <br />WHEREAS, this Council by a vote of at least five (5) members thereof determines that this <br />resolution is an emergency measure, and that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, <br />and that it is necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that applications for financial <br />assistance must be made to the Ohio Public Works Commission no later than September 30, 2011; <br />now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That the Mayor, for and on behalf of the City, is authorized to apply to the <br />District One Public Works Integratnng Committee and the Director of the Ohio Public Works <br />Commission for financial assistance for the following capital improvement project(s): <br />Madison Avenue Improvement Project <br />
