REFERRED TO THE FINANCE COMMITTEE 11/21/11 2ND READING 12/5/11. RESOLUTION NO. 8534-11 BY: Anderscy, Juris, Madigan, Nowlin, Powers, Smith. A RESOLUTION to take effect immediately provided it received the affirmative vote of at least five (5) members of Council or otherwise, it shall take effect and be in force after the earliest period allowed by law, to enter into an agreement with the District Advisory Council of Cuyahoga County, Ohio General Health District for the provision of public health services within the City of Lakewood in an amount not to exceed Two Hundred Thousand, One Hundred Eighty-Three Dollars ($200,183.00) for aone-year period commencing January 1, 2012. WHEREAS, the Cuyahoga County Board of Health has proposed providing public heath services for residents of the City of Lakewood at a per capita rate of $3.84; and WHEREAS, it is necessary to continue public health services to residents of the City of Lakewood through the District Advisory Council of Cuyahoga County, Ohio General Health District; and WHEREAS, this Council by a vote of at least five (5) of its members determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal in that this agreement must be in effect prior to January 1, 2012 to continue health services; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. The Mayor, on behalf of the City, is hereby authorized to enter into an agreement with the District Advisory Council of Cuyahoga County, Ohio General Health District for the provision of public health services within the City of Lakewood in an amount not to exceed Two Hundred Thousand, One Hundred Eighty-three Dollars ($200,183.00) for a one year period commencing January 1, 2012 pursuant to the authority granted in Section 3709.07 of the Ohio Revised Code. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 3. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this resolution, and provided it receives the affirmative vote of at least five (5) of its members elected to Council, this resolution shall take effect and be in force immediately upon its adoption
