"Maintenance"; all costs related thereto being hereinafter referred to as the "Maintenance <br />Costs"). <br />(b) Any damage caused to the Common Access Drive or the <br />Lakewood Parcel by reason of construction or other extraordinary activities or damage to <br />the Common Access Drive or• the Lakewood Parcel caused by use attributable to the <br />activities of an owner or occupant of a particular Parcel will be the responsibility of the <br />owner or occupant causing such damage. During the construction of improvements, the <br />owner of the Parcel being improved will promptly repair any damage done to the <br />Common Access Drive or the Lakewood Parcel caused by such owner or its lessees, <br />agents, contractors, or subcontractors, and upon completion of such improvements, the <br />owner or occupant of the Parcel being improved will restore the Common Access Drive <br />or the Lakewood Parcel to a condition equal to or better than that existing prior to <br />commencement of such work. <br />(c) Drug Mart shall be solely responsible for the performance of the <br />maintenance, repairs and replacements necessary to maintain the rubbish collection <br />system easement and related equipment located on the Lakewood Parcel in good <br />condition and repair, including repairing damage caused by its customers, invites, vandals <br />or other casualty. <br />(d) Discount Drug Mart, its successors and assigns benefitting from <br />this Agreement shall snowplow and keep free from ice the Common Access Drive of the <br />Lakewood Parcel. <br />(e) Discount Drug Mart, its successors and assigns benefitting from <br />this Agreement and Lakewood shall each maintain and fully comply with all workers' <br />compensation laws of the State of Ohio and shall maintain private insurance coverage, of <br />such type or designation, and with such policy limitations and amount of coverage, as is <br />necessary and sufficient to cover the use of the Common Access Drive as set forth herein. <br />Discount Drug Mart, its successors and assigns benefitting from this Agreement shall <br />name Lakewood as an "additional insured" with respect to activities undertaken by the <br />beneficiary of this easement on the Common Access Drive on such policies of insurance. <br />Lakewood shall name Discount Drug Mart, its successors and assigns benefitting from <br />this Agreement as an "additional insured" with respect to activities undertaken by <br />Lakewood on the Common Access Drive on such policies of insurance. A certificate of <br />coverage showing each party as an "additional insured" shall be made available to the <br />other party upon request. <br />4. Miscellaneous. <br />(a) Each easement granted by this Agreement will be non-exclusive <br />and perpetual, except as expressly set forth herein. <br />-3- <br />
