City of Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health and safety, and to provide for the usual daily operation of municipal deparhnents in that <br />this resoltttion is required to be postmarked and sent to the Division of Liquor Conhrol by <br />September 1, 2012; now, therefore; <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section L Counci] hereby objects to the renewal of the Cl and C2 liquor permit issued <br />by the Ohio Department of Commerce, Division of Liquor Conri•ol to D Madison Avenue <br />Lakewood Gas LLC at the establishment located at 14235 Madison Avenue, Lakewood, Ohio <br />44107, permit No. 1800018, for the reasons set forth above and in accordance with the provisions <br />of Section 4303.292 of the Ohio Revised Code, and requests a hearing on the same. <br />Section 2. The Clerk of Council is hereby authorized and directed to forward a certified <br />copy of this resolution together with a letter requesting that the hearing be held in Cleveland, <br />Cuyahoga County, Ohio, to the Division of Liquor Control, State of Ohio, Permit Division, <br />forthwith, located at Ohio Department of Commerce, Division of Liquor Control, Licensing <br />Office, 6606 Tussing Rd., P.O. Box 4005, Reyuoldsburg, Ohio 43068-9005. <br />Section 3. This Council designates the Law Department of the City of Lakewood to <br />represent it and the City at any hearings before the Division of Liquor Control. <br />Section 4. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resoltttion were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public incompliance with atl legal requirements. <br />Section 5. This resolution is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in its preamble, <br />and provided it receives the affirmative vote of at least five of its members, this resolution shall <br />take effect and be in force inunediately upon its adoption by the Cotmcil and approval by the <br />Mayor, or otherwise it shall take effect and be in force after the earliest period allowed by law. <br />Adopted: ~ ~.. <br />Approved: ~ L`}~ ~-- <br />PRESIDENT <br />
