Referred to the Committee of the Whole 3/18/13 RESOLUTION NO. 8642-13 BY: Anderson, Bullock, Juris, Madigan, Nowlin, Powers, Smith. A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five members of Council, or otherwise to take effect at the earliest period allowed by law, declaring it necessary to improve Arthur Avenue (from Detroit Avenue to Hilliard Road) by replacing the existing sheet lighting system and installing decorative lighting fixtures and associated infrastructure including the necessary removal of existing utility poles and overhead wires and associated appurtenances and the installation of underground conduits, lampposts, lighting fixtures, electrical transmission devices and controls, together with the performance of any necessary tree lawn repair, and including all necessary appurtenances thereto. WHEREAS, a majority of residential property owners of Arthur Avenue between De- troit Avenue and Hilliard Road wish to have the street improved as described above it the title of this resolution and have demonstrated such tluough the signing of a petition in support of self-assessment for the cost associated with such; and WHEREAS, the City desires to assist the property owners of that section of Arthm• Av- enue by making these improvements and permitting the property owners the benefit of paying for these improvements by way of special assessment; and WHEREAS, this Council by a vote of at least five of its members determines that this resolution is an emergency measure, that it shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lake- wood, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that the 2013 construction season is upon us; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. It is necessary to improve Arthur Avenue (from Detroit Avenue to Hilliard Road) in the City of Lakewood. Section 2. Said section of Arthur Avenue shall be improved in accordance with specifi- cations hereinafter referred to and now on file in the office of the Engineering Division, includ- ing the installation of decorative lighting fixtures and associated infrastructure including the necessary removal of existing utility poles and overhead wires and associated appurtenances and the installation of underground conduits, lampposts, lighting fixtures, electrical transmis-
