SECTION 4. The percentage of the tax exemption on the increase in the assessed <br />valuation resulting from improvements to Qualified Residential Facilities shall be between fifty <br />percent (50 %) and one hundred percent (100 %) after completion and application. <br />SECTION 5. Applications for abatement must be filed by the individual property owner <br />where the improvement is made to a dwelling containing less than two family units or an <br />individual condominium. Only one application per project for abatement shall be submitted for <br />common areas of condominium buildings by the president of the association on behalf of the <br />association, if the property is titled to the association, or on behalf of the individual owners, if the <br />property is titled to the individual owners. <br />SECTION 6. Any exemption approved by the City shall exempt only that value that was <br />added to parcel(s) as a result of the project above the baseline tax value for the parcel(s). All <br />owners of properties subject to exemption shall be required to make ordinary real property tax <br />payments or, alternatively, payments in lieu of tax payments in an amount equal to the tax <br />assessment for the baseline tax value of the project to the County Fiscal Officer in accordance <br />with the normal process procedures and deadlines established for real property tax collection. <br />SECTION 7. All projects in Community Reinvestment Area 44 seeking tax abatement <br />pursuant to this resolution are required to comply with the State of Ohio application fee <br />requirements of Section 3735.672(C) of the Revised Code. <br />SECTION 8. To administer and implement the provision of this resolution, the City's <br />Assistant Housing Commissioner is designated as the Housing Officer as described in Sections <br />3735.65 through 3735.70 of the Revised Code. <br />SECTION 9. The Housing Officer shall verify that all work has been completed under <br />proper building permits and completed in compliance with all building codes, zoning codes and <br />any other applicable laws. If the Housing Officer cannot verify that all work has been completed <br />in a manner that complies with all building codes, zoning codes and any other applicable laws, <br />then the Housing Officer shall not authorize an exemption under the authority granted by <br />resolution. <br />SECTION 10. The Community Reinvestment Area Housing Council shall make an annu- <br />al inspection of the properties within the Area for which an exemption has been granted under <br />Section 3735.67 of the Revised Code. The Housing Council shall also hear appeals under Section <br />3735.70 of the Revised Code and meet no less than once annually to fulfill the duties imposed by <br />Revised Code Section 3735.69. <br />SECTION 11. A copy of this resolution shall be forwarded to the Cuyahoga County <br />Fiscal Officer; and a copy of this resolution shall be published in a newspaper of general <br />circulation in the City once a week for two consecutive weeks immediately following its <br />passage. <br />SECTION 12. The Director of Planning and Development of the City is hereby directed <br />and authorized to petition the Director of Development Services Agency of the State of Ohio to <br />
