REFERRED TO THE FINANCE COMMITTEE 5/6/13. <br />RESOLUTION NO. 8656 -13 BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powers, Smith. <br />A RESOLUTION to take effect immediately provided it receives the vote of at least five <br />members of Council, or otherwise to take effect at the earliest period allowed by law, authorizing <br />the Mayor to enter into various agreements with Beck Center for the Arts, an Ohio non -profit <br />corporation, which govern the rights and obligations of the parties relative to parcels of land <br />identified as permanent parcel numbers 311 -24 -066 and 311 -24 -067; document the City's contri- <br />bution of $50,000.00 to the Beck Center's parking lot resurfacing project under certain terms in- <br />eluding those related to stormwater management; and reaffirm the parties' commitment to the <br />Beck Center's long -term viability within the City. <br />WHEREAS, the City wishes to enter into a revised easement agreement with Beck Center <br />for the Arts, an Ohio non - profit corporation, governing the rights and obligations of the parties <br />relative to parcels of land identified as permanent parcel numbers 311 -24 -066, the Beck Center's <br />rear parking lot, and 311 -24 -067, the City's Wayne Avenue facilities; and <br />WHEREAS, the City wishes to enter into a related agreement with Beck Center for the <br />Arts documenting the City's contribution of $50,000.00 to the Beck Center's parking lot resur- <br />facing project under certain terms, including those related to stormwater management, and reaf- <br />firming the parties' commitment to the Beck Center's long -term viability within the City; and <br />WHEREAS, all contracts not specifically excepted by ordinance must be approved by <br />Council pursuant to Section 111.02 of the Codified Ordinances; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits munic- <br />ipalities to exercise all powers of local self - government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />and <br />WHEREAS, this Council by a vote of at least five of its members determines that this <br />resolution is an emergency measure and that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood <br />and that it is necessary for the immediate preservation of the public property, health, and safety <br />and to provide for the usual daily operation of municipal departments in that the City wishes to <br />enter into the easement agreement for the parcel immediately, as there may now be no agreement <br />governing its use; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />
