REFERRED TO THE COMMITTEE OF THE <br />14HOLE 5/20/13. <br />RESOLUTION NO. 8657 -13 BY: Anderson, Bullock, Juris, Madigan, <br />.Nowlin, Powers, Smith. <br />A RESOLUTION to take effect immediately provided it receives the vote of at least five <br />members of Council, or otherwise to take effect at the earliest period allowed by law, authorizing <br />the Director of Planning and Development to enter into one or more agreements with a consult- <br />ant, following the receipt of proposals, for services related to designing improvements to the area <br />,within Lakewood Park near the waterfront, in an amount not to exceed $25,000.00. <br />WHEREAS, the City wishes to enter into a consulting agreement for the design of im- <br />provements to the area near Lakewood Park's waterfront, following receipt of proposals from <br />qualified firms, in an amount not to exceed $25,000.00; and <br />WHEREAS, all contracts not specifically excepted by ordinance must be approved by <br />Council pursuant to Section 111.02 of the Codified Ordinances; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits munic- <br />ipalities to exercise all powers of local self - government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />and <br />WHEREAS, this Council by a vote of at least five of its members determines that this <br />resolution is an emergency measure and that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood <br />and that it is necessary for the immediate preservation of the public property, health, and safety <br />and to provide for the usual daily operation of municipal departments in that the City wishes to <br />enter into the consultancy agreement for the improvement design immediately, as there may be <br />opportunity to make progress during the warm weather months of 2013; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Director of Planning and Development is authorized to enter into one or <br />more agreements with a consultant, following the receipt of proposals in response to the request <br />for proposals attached hereto as Exhibit A (or a substantially similar request for proposals), for <br />services related to designing improvements to the area within Lakewood Park near the water- <br />front, in an amount not to exceed $25,000.00. <br />Section 2. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this council, <br />and that all such deliberations of this Council and anv of its committees that resulted in such <br />formal action, were in meetings open to the public, in compliance with all legal requirements. <br />
