REFERRED TO THE COMMITTEE OF THE 14HOLE 5/20/13. RESOLUTION NO. 8657 -13 BY: Anderson, Bullock, Juris, Madigan, .Nowlin, Powers, Smith. A RESOLUTION to take effect immediately provided it receives the vote of at least five members of Council, or otherwise to take effect at the earliest period allowed by law, authorizing the Director of Planning and Development to enter into one or more agreements with a consult- ant, following the receipt of proposals, for services related to designing improvements to the area ,within Lakewood Park near the waterfront, in an amount not to exceed $25,000.00. WHEREAS, the City wishes to enter into a consulting agreement for the design of im- provements to the area near Lakewood Park's waterfront, following receipt of proposals from qualified firms, in an amount not to exceed $25,000.00; and WHEREAS, all contracts not specifically excepted by ordinance must be approved by Council pursuant to Section 111.02 of the Codified Ordinances; and WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits munic- ipalities to exercise all powers of local self - government and to adopt and enforce within their limits such as local police, sanitary and other regulations as are not in conflict with general laws; and WHEREAS, this Council by a vote of at least five of its members determines that this resolution is an emergency measure and that it shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments in that the City wishes to enter into the consultancy agreement for the improvement design immediately, as there may be opportunity to make progress during the warm weather months of 2013; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The Director of Planning and Development is authorized to enter into one or more agreements with a consultant, following the receipt of proposals in response to the request for proposals attached hereto as Exhibit A (or a substantially similar request for proposals), for services related to designing improvements to the area within Lakewood Park near the water- front, in an amount not to exceed $25,000.00. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this council, and that all such deliberations of this Council and anv of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements.
