EXHIBIT A <br />CITY OF LAKEWOOD PROGRAM GUIDELINES <br />WESTSHORE REGIONAL COMMUNITY EMERGENCY RESPONSE TEAM <br />L Definitions <br />(A)As used herein, unless another definition is provided or the context otherwise requires, <br />the Westshore Regional Community Emergency Response Team (WSC) shall refer to <br />and serve as a regionally sponsored volunteer organization as a unit of the City of Lake- <br />wood Department of Public Safety, Division of Fire, and the Westshore Council of Gov- <br />ernments, operating through the fire chief or his or her designee. The organization and <br />structure of the WSC shall be subject to the review of the Westshore Council of Govern- <br />ments and substantially comply with the organization and structure recommended by the <br />Federal Emergency Management Agency, the State of Ohio, and Cuyahoga County Of- <br />fice of Emergency Management, and be compatible with the National Incident Manage- <br />ment System. <br />(B) "Westshore Council of Governments" or "Westshore Council of Governments city" shall <br />refer to the cities of Bay Village, Fairview Park, Lakewood, North Olmsted, Rocky Riv- <br />er, and Westlake, as they are organized in a council of governments in accordance with <br />the Ohio Revised Code. <br />II. WSC Volunteer Status <br />(A) Volunteer Status; Immunity. <br />(1) All WSC members shall serve as emergency management volunteers only and shall <br />not be deemed to be employees of the City of Lakewood or the Westshore Council of <br />Governments for purposes of entitlement to compensation and fringe benefits, includ- <br />ing workers' compensation and unemployment compensation. <br />(2) WSC members shall not seek or accept any monetary compensation of any kind for <br />volunteer service, and shall acknowledge and agree that any loss or injury incurred <br />during service shall be solely at the risk of the volunteer, waiving any and all claims <br />for himself or herself and his or her heirs and assigns, and agreeing to hold harmless <br />the City of Lakewood, Ohio, and the Westshore Council of Governments, their em- <br />ployees and agents from any such loss or injury, provided that such indemnity shall <br />not be effective for damages that result from intentional acts of the City or the <br />Westshore Council of Governments, their employees or agents. WSC members must <br />document their volunteer status on waiver forms provided by the Westshore Council <br />of Governments prior to participating in any activities. <br />(3) Emergency management volunteer status described herein shall be consistent with <br />and be afforded immunity from liability pursuant to Rev. Code § 5502.30, and shall <br />generally constitute a government function. <br />
