SUBSTITUTE FOR RESOLUTION 8699 -14 REFERRED TO COMMITTEE <br />OF THE WHOLE 1 -6 -14 <br />RESOLUTION NO. 8699 -14 BY: Anderson, Bullock, Juris, <br />Madigan, Marx, Nowlin. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of at <br />least five members of Council, or otherwise to take effect and be in force after the earliest period <br />allowed by law, appointing Samuel T. O'Leary to the office of Councilmember, Ward 2, for the <br />unexpired term ending December 31, 2015. <br />WHEREAS, Article III, Section 2 of the Second Amended Charter of the City of Lakewood <br />provides that vacancies in Council shall be filled by its remaining members, and that the term of any <br />appointee filling such a vacancy shall expire at the end of the unexpired term of the former <br />councilmember; and <br />WHEREAS, there exists a vacancy in the office of Councilmember, Ward 2, as of January 1, <br />2014; and <br />WHEREAS, this Council by a vote of at least five of its members determines that this <br />resolution is an emergency measure and that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and <br />that it is necessary for the immediate preservation of the public property, health and safety, and to <br />provide for the usual daily operation of municipal departments in that the office to be occupied by <br />this appointee is currently vacant; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Council appoints Samuel T. O'Leary to the office of Councilmember, Ward 2, for <br />the unexpired term ending December 31, 2015. <br />Section 2. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this resolution were passed in open meetings of this Council and that all <br />deliberations of this Council and any of its committees that resulted in such actions were in meetings <br />open to the public and in compliance with legal requirements. <br />Section 3. This resolution is hereby declared to be an emergency measure necessary for the <br />immediate preservation of the public peace, property, health, safety and welfare in the City and for <br />the usual daily operation of the City for the reasons set forth and defined in the preamble to this <br />ordinance, and provided it receives the affirmative vote of at least five of members of Council, this <br />resolution shall take effect and be in force immediately upon its adoption by the Council and <br />approval by the Mayor, or otherwise it shall take effect and be in force after the earliest period <br />allowed by law. <br />Adopted: °7a y�u�cal i 2J 1 y <br />7Q I,,& (It 2 11 20 t1-f <br />Approved: <br />l i�9 "'t, <br />
