accordance with the Alternatives to Brownfield Clean up Analysis ( "ABCA "), all Applicable <br />Standards and, if applicable, the Ohio Voluntary Action Program ( "VAP "), (as defined in <br />Schedule 1)]; <br />5.3 Changes in Subgrantee's Work. Subgrantee agrees that no material changes will be made <br />in the Subgrantee's Work except upon the written approval of the same by Grantor. Grantor may <br />require Subgrantee to modify cleanup activities as Grantor deems necessary based upon <br />comments received from the public or on any new information acquired (including unforeseen <br />circumstances). <br />5.4 Records and Accounting of Funds. Subgrantee shall maintain financial and <br />programmatic records (including, without limitation, all environmental information concerning <br />the Project, and all records of its procurement of contractors and subcontractors,) in accordance <br />with generally accepted accounting principles and procedures and shall retain such records <br />pertaining to the Project for a minimum three -year period following the latest to occur of (i) <br />Completion Date, (ii) the termination of the Cooperative Agreement, (iii) the repayment of the <br />Grant and satisfaction of the covenants, conditions and requirements to be performed hereunder <br />(iv) for those records subject to audit, once any audit findings have been resolved. If any <br />litigation, claim, negotiation, audit or other action involving the records is commenced prior to <br />the expiration of the three -year period, such records shall be retained until final resolution of all <br />issues which arise from such litigation, claim, negotiation, audit or other action, or until the end <br />of the three -year period, whichever is later. All such records and supporting documents shall be <br />made available by Subgrantee, upon request, for inspection, or audit by the Grantor or its <br />representatives and any Federal or other authorized governmental personnel at all reasonable <br />times hereafter during business hours, and Subgrantee shall permit Grantor or any of its agents <br />and any Federal or other authorized governmental personnel to copy and make abstracts from <br />any and all of said books and records. In addition, Subgrantee shall obtain the permission from <br />the Grantor or the USEPA, in writing, prior to destroying any of these records or documents; <br />5.5 Report s. In addition to any other reporting requirements contained in this Agreement, <br />Subgrantee shall submit to Grantor written, quarterly reports which identify the activities <br />performed during the previous quarter utilizing Grant Funds (relating to USEPA - funded <br />activities and the objectives and milestones agreed upon in the Remedial Action Plan or <br />Specifications), and such other information that the Grantor reasonably requests, including the <br />information concerning compliance with Cross Cutting requirements and MBE /WBE/DBE good <br />faith efforts as required in Sections 5.11 and 5.12 of this Agreement. Subgrantee shall use <br />recycled paper and double sided printing for all written reports which are prepared pursuant to <br />this Agreement. <br />5.6 Furnishing Information and Notice. Subgrantee shall: <br />(a) promptly notify Grantor of any problems, delays or adverse conditions which will <br />materially impair the ability to complete the Project in accordance with the Remedial <br />Action Plan, the Budget, and/or the Work Schedule, <br />10 <br />
