RESOLUTION NO. 8770 -14 BY: Anderson, Bullock, Juris, Madigan, Marx, Nowlin, O'Leary. A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five members of council, or otherwise to take effect at the earliest period allowed by law, declaring it necessary that the Director of Public Works be permitted to enter into a con- tract with Gable Elevator without the requirement of competitive bidding in order to make an emergency repair to the elevator at the Lawther Center in the City. WHEREAS, Section 111.04(a)(3) of the Codified Ordinances allows for a waiver of the competitive bidding requirements for contracts exceeding $7,500 when Council determines it is necessary to contract for emergency repairs; and WHEREAS, an emergency exists as the building, without a filly operating elevator is not accessible to the clients that the Lawther Center serves; and WHEREAS, an initial estimate in the amount of $31,000 has been obtained from Gable Elevator; and WHEREAS, as the work proceeds, additional repairs may be required up to a total amount of $62,000; and WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits mu- nicipalities to exercise all powers of local self - government and to adopt and enforce within their limits such as local police, sanitary and other regulations as are not in conflict with general laws; and WHEREAS, this Council by a vote of at least five of its members determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is necessary to provide for the usual daily operation of municipal departments in that the non - functioning elevator requires emergency repairs; now, therefore: BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. This Council hereby declares it necessary pursuant to Section 111.04(a)(3) of the Codified Ordinances that the Director of Public Works be permitted to enter into a contract with Gable Elevator in the approximate amount of $62,000 without the requirement of competi- tive bidding in order to meet an emergency in the City. The contract for such work shall consist of Gable Elevator's quote and the city of Lakewood's purchase order. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council,
