Please substitute <br />for the original. <br />RESOLUTION NO. 8793 -15 BY: Anderson, Juris, Madigan, <br />Marx, Nowlin. <br />A RESOLUTION to take effect immediately provided it receives the affirmative <br />vote of at least five members of Council, or otherwise to take effect and be in force after <br />the earliest period allowed by law, authorizing and directing the Mayor to enter into an <br />agreement with the Cleveland Clinic Foundation (CCF) which will allow police officers <br />employed by the Cleveland Clinic Police Department to exercise limited police powers <br />within the City of Lakewood on and around hospital property operated by CCF. <br />WHEREAS, the CCF has a police department established under the authority of <br />O.R.C. §4973.17(D); and <br />WHEREAS, an agreement is required in order for the special police officers hired <br />by CCF to have misdemeanor arrest authority within the city of Lakewood; and <br />WHEREAS, this Council by a vote of at least five of its members determines that <br />this resolution is an emergency measure, and that this resolution shall take effect at the <br />earliest date possible as set forth in Article III, Sections 10 and 13 of the Second <br />Amended Charter of the City of Lakewood, and that it is necessary for the immediate <br />preservation of the public peace, property, health and safety, and to provide for the usual <br />daily operation of municipal departments it is in the best interest of the City to allow <br />special police officers appointed by the CCF to have police powers on certain hospital <br />property owned by the city of Lakewood and operated by CCF; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor, as Director of Public Safety, is hereby authorized to enter <br />into an agreement, in substantially the form as attached as Exhibit 1, with the Cleveland <br />Clinic Foundation granting authority for special police officers appointed by the CCF to <br />exercise police powers in accordance with O.R.C. §4973.17 on and around hospital <br />property owned by the city of Lakewood and operated by CCF. <br />Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resolution were adopted in an open meeting <br />of this Council, and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action, were in meetings open to the public in <br />compliance with all legal requirements. <br />Section 3. This resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety and <br />welfare in the City and for the usual daily operation of the City for the reasons set forth <br />and defined in the preamble to this resolution, and provided it receives the affirmative <br />vote of at least five members of Council, this resolution shall take effect and be in force <br />
