Referred to Public Safety Committee 10/5/15. <br />Please substitute for the original. , <br />RESOLUTION NO. 8825 -15 By :Anderson, Bullock, Juris, <br />Madigan, Marx, Nowlin, O'Leary. <br />A RESOLUTION to take effect immediately provided. it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest pe- <br />riod allowed by law, to authorize the Mayor, as Director of Public Safety, to enter into an agree- <br />ment between the City of Cleveland and the State of Ohio for the interchange of public safety <br />services for the 2016 Republican National Convention in Cleveland, Ohio. <br />WHEREAS, the Cities of Lakewood and Cleveland and the State of Ohio wish to allow <br />all police and law enforcement officers to perform any police function, exercise any police pow- <br />er, or render any police service within the jurisdiction of any of the contracting entities; and <br />WHEREAS, Ohio Revised Code §737.04 provides authority for municipalities and polit- <br />ical subdivisions to contract for the interchange of police services; and <br />WHEREAS, in order to collaboratively provide police protection and reduce crime, it is <br />the desire of the parties to this agreement to provide for and join in providing for mutual assis- <br />tance and the interchange of their respective personnel and equipment; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power to enact laws that are for the health, safety, welfare, comfort <br />and peace of the citizens of the municipality; and <br />WHEREAS, this Council by a vote of at least five of its members determines that this <br />resolution is an emergency measure, and that this resolution shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City <br />of Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health and safety, and to provide for the usual daily operation of municipal departments in that <br />this agreement is necessary to immediately provide for mutual aid between the party subdivi- <br />sions; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor, as Director of Public Safety, to enter into an agreement between <br />the City of Cleveland and the State of Ohio for the interchange of public safety services for the <br />2016 Republican National Convention in Cleveland, Ohio in substantially the same form as the <br />agreement attached as Exhibit A. <br />Section 2. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this Council, <br />and that all such deliberation of the Council and of any of its committees that resulted in such <br />
