RESOLUTION NO. 8881 -16 BY: Anderson, Bullock, Litten, <br />Marx, Nowlin, O'Leary, I'Malley. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least <br />five members of Council, or otherwise to take effect and be in force after the earliest period allowed by <br />law, authorizing the Mayor to enter into a cooperative agreement with the City of Cleveland for the <br />resurfacing of Lakewood Heights Boulevard from Chesterland Avenue to Alger Avenue in the Cities of <br />Lakewood and Cleveland with the assistance of the Ohio Department of Transportation. <br />WHEREAS, Lakewood Heights Boulevard is located with the Cities of Lakewood and <br />Cleveland; and <br />WHEREAS, Lakewood will be the lead on the resurfacing project and will enter into all <br />necessary agreements with the Ohio Department of Transportation and necessary contractors for the <br />performance of the work as well as oversee the project; and <br />WHEREAS, the cost of the project to be shared by Lakewood and Cleveland is now estimated in <br />the amount of $394,070.00, with Lakewood to pay 43% of the final cost and Cleveland to pay 57% of the <br />final cost; and <br />WHEREAS, this Council by a vote of at least five members thereof determines that this <br />resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible <br />as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, <br />and that it is necessary for the immediate preservation of the public property, health and safety, and to <br />provide for the usual daily operation of municipal departments and for the scheduling of street <br />improvement projects; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor is hereby authorized to enter into an agreement, attached as Exhibit "A," <br />with Cleveland providing for the cooperation in the resurfacing of Lakewood Heights Boulevard with the <br />assistance of the Ohio Department of Transportation. <br />Section 2. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this resolution were adopted in an open meeting of this Council, and that all <br />such deliberation of the Council and of any of its committees that resulted in such formal action were in <br />meetings open to the public in compliance with all legal requirements. <br />Section 3. This resolution is hereby declared to be an emergency measure necessary for the <br />immediate preservation of the public peace, property, health, safety and welfare in the City and for the <br />usual daily operation of the City for the reasons set forth and defined in the preamble to this resolution, <br />and provided it receives the affirmative vote of at least five members of Council, this resolution shall take <br />effect and be in force immediately upon its adoption by the Council and approval by the Mayor, or <br />otherwise it shall take effect and be in force after the earliest period allowed by law. <br />
