grievance procedure in order to promote the expeditious resolution of any <br />grievance. <br />10.06 The FOP /OLC (in its capacity as exclusive representative of the employees covered by <br />this Agreement) shall have final authority to withdraw or terminate the processing of a grievance <br />at any Step, should the FOP /OLC determine that the grievance lacks merit or justification, or that <br />it has been settled or adjusted in a fair and equitable manner consistent with the terms of this <br />Agreement, and in the interest of the continuing relationship of the parties. <br />10.07 The grievance procedure set forth in this Article shall be the sole and exclusive method <br />for resolving matters which constitute grievances under this Agreement. Any decisions, results <br />or settlements reached under the terms of this Grievance Procedure, whether reached by an <br />arbitrator's decision or at any pre- arbitration step of the procedure, shall be final, conclusive and <br />binding upon the City, the FOP /OLC and the employee. <br />10.08 The grievance committee shall consist of bargaining unit member(s) designated by the <br />FOP /OLC. <br />10.09 A Labor /Management Committee consisting of the Director of Human Resources, or <br />designated representative, the Lakewood Chief of Police, or designated representative, and <br />representatives of the Dispatchers shall meet at least once ever three (3) months for the purpose <br />of discussing and attempting to resolve any mutual work related problems. <br />ARTICLE 11 PROBATIONARY PERIOD <br />11.01 New full -time employees shall be considered to be on probation for a period of one (1) <br />year and during such probationary period, the City shall have sole discretion to discipline or <br />discharge such employees, and such actions during this period shall not be reviewed through the <br />Grievance Procedure. <br />11.02 If an employee is discharged or quits while on probation and is later rehired, they shall be <br />considered a new employee and subject to the provisions of Section 11.01 of this Article. <br />ARTICLE 12 SENIORITY <br />12.01 Dispatcher, for the purpose of layoff; seniority shall be their continuous service with the <br />City. <br />12.02 Dispatchers shall have no seniority during the probationary period, but upon completion <br />of the probationary period will receive seniority retroactively to the date of hire. The City shall <br />provide the Union with a copy of the seniority list, updated annually. The list shall contain, in <br />order of seniority, the name and date of hire of each employee. Seniority shall be broken when <br />an employee: <br />A. Quits or resigns. <br />7 <br />
