Attachment A <br />Subcontract between Design Builder and Subcontractor <br />City of Lakewood <br />Wastewater Treatment Plant Anaerobic Digestion Project ( "Project') <br />This Agreement is a subcontract entered into between the Design Builder (DB) and the Subcontractor in <br />connection with the Project. This Subcontract is required in accordance with the Design/Build <br />Agreement between the DB and the City of Lakewood with respect to the above Project and each <br />subcontractor and /or supplier of the DB is required to execute this agreement as a condition of <br />proceeding forward with its subcontract work and/or supply of materials. <br />Project: The Project is associated with the design, EPA permitting and construction of an <br />anaerobic sewage sludge digestion system (the "Process ") and energy recovery system ( "the <br />Project. ") The waste fueled energy plant will include at a minimum the design, permitting, <br />turnkey supply of the equipment and facility including all site work, installation, start -up, and <br />acceptance testing and operation of a facility that will potentially generate heat and /or electricity <br />which will be used at the Lakewood Wastewater Treatment Plant. This Davis Bacon Project will <br />utilize the Design -Build ( "Design - Build ") Project delivery method. <br />The Public Authority: The City of Lakewood, State of Ohio ( "the City. ") The Design/Build Contract <br />between the DB and the City shall be administered by the City of Lakewood and its representatives, <br />including City Engineer Mark K. Papke, 12650 Detroit Ave., Lakewood, Ohio as more fully addressed <br />in the Contract Documents. <br />ARTICLE 1. CONTRACT DOCUMENTS. - NATURE OF SUBCONTRACT <br />1.1 The Subcontractor shall perform the entire Subcontract Work as specified and identified as the <br />"Scope of Work" in Exhibit "A." <br />ARTICLE 2 - COMPENSATION <br />2.1 The DB agrees to pay for the performance of this Subcontract, subject to additions and deductions as <br />provided in the Contract Documents (all of which shall be subject to the approval of the City in <br />accordance with the Contract Documents), the Subcontract Sum of $ <br />comprised of the following: <br />The Subcontract Components of the Subcontract Work are generally described as follow and shall be <br />performed in accordance with the Scope of Work identified in Exhibit "A ": <br />301Page <br />
