REFERRED TO THE FUHLTCESAVW1 ZTTEE <br />COMMITTEE 12/4/17• DEFERRED 3/5/18. <br />RESOLUTIONNO. 8970 -17 BY: Anderson, Bullock, George, <br />Litten, O'Malley. <br />A RESOLUTION to take effect immediately provided it receives the affirmative <br />vote of at least two thirds of the members of Council, or otherwise to take effect and be in <br />force after the earliest period allowed by law, authorizing and directing the Mayor to <br />enter into an amended agreement with the Cleveland Clinic Foundation (CCF) which will <br />allow police officers employed by the Cleveland Clinic Police Department to exercise <br />limited police powers within the City of Lakewood on and around hospital property <br />owned or operated by CCF. <br />WHEREAS, the CCF has a police department established under the authority of <br />O.R.C. §4973.17(D); and <br />WHEREAS, an agreement is required in order for the special police officers hired <br />by CCF to have misdemeanor arrest authority within the city of Lakewood; and <br />WHEREAS, the current such agreement with CCF, authorized under the authority <br />of Resolution No. 8793 -15, is scheduled to expire on December 31, 2017; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City <br />of Lakewood, this Council by a vote of at least two thirds of its members determines that <br />this resolution is an emergency measure and that it shall take effect immediately, and that <br />it is necessary for the immediate preservation of the public property, health, and safety <br />and to provide for the usual daily operation of municipal departments, in that the current <br />agreement is scheduled to expire on December 31, 2017; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor, as Director of Public Safety, is hereby authorized to enter <br />into an amended agreement, in substantially the form as attached as Exhibit 1, with the <br />Cleveland Clinic Foundation granting authority for special police officers appointed by <br />the CCF to exercise police powers in accordance with O.R.C. §4973.17 on and around <br />hospital property owned or operated by CCF. <br />Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resolution were adopted in an open meeting <br />of this Council, and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action, were in meetings open to the public in <br />compliance with all legal requirements. <br />Section 3. This resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety and <br />welfare in the City and for the usual daily operation of the City for the reasons set forth <br />
