REFERRED TO THE FINANCE COMMITTEE <br />1 -2 -18. <br />RESOLUTIONNO. 8975 -18 BY: Anderson, Bullock, George, Litten, <br />O'Leary, O'Malley, Rader. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force after <br />the earliest period allowed by law, authorizing the Purchasing Manager to enter into an <br />agreement for prisoner meals with Discount Drug Mart without the necessity of bidding in <br />accordance with Lakewood Codified Ordinance §I11.04(a)(10) in accordance with the City of <br />Lakewood standard purchase order terms and conditions. <br />WHEREAS, the City of Lakewood must provide meals to prisoners housed in the <br />Lakewood Jail; and <br />WHEREAS, traditionally when this contract is bid there has only been one respondent, <br />Madison By -Rite, who is no longer in business; and <br />WHEREAS, an REP process was conducted to try to initiate new interest in the provision <br />of meals and was sent to Sapell's, Giant Eagle and Discount Drug Mart; and <br />WHEREAS, Discount Drug Mart was the only business to submit pricing; and <br />WHEREAS, it is in the best interest of the City to purchase prisoner meals without <br />bidding in order to ensure that delivery of meals for prisoner consumption continues <br />uninterrupted; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments in order to take advantage of this <br />competitive pricing before the quote expires; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Council hereby determines that it is impractical to award the purchase of <br />prisoner meals under competitive bidding procedures, and that it is more cost - effective and in the <br />best interests of the City to award the contract without competitive bidding, and thus authorizes <br />the Purchasing Manager to award a contract to Discount Drug Mart for the purchase of Prisoner <br />Meals. <br />Section 2. Council specifically approves the quote provided by Discount Drug Mart <br />attached as Exhibit A, together with the City of Lakewood's standard purchase order, as the <br />contract for this matter. <br />
