REFERRED TO THE FINANCE COMMITTEE <br />3/19/18. <br />RESOLUTIONNO. 8993 -18 BY: Anderson, Bullock, George, Litten, <br />O'Leary, O'Malley, Rader. <br />A RESOLUTION to take effect immediately provided it receives the vote of at least two <br />thirds of the members of Council, or otherwise to take effect at the earliest period allowed by <br />law, authorizing the Mayor, Director of Public Works, Finance Director, Law Director or City <br />Engineer to apply for, accept and enter into a Water Pollution Control Loan Fund ( "WPCLF ") <br />Agreement on behalf of the city for planning, design and construction of the High Rate Treat- <br />ment Facility Waste Water Treatment Plant Improvements Project ("Wastewater Facilities ") and <br />designating a dedicated repayment source for the loan, <br />WHEREAS, Lakewood seeks to upgrade its existing waste water treatment plant; and <br />WHEREAS, Lakewood intends to apply for a WPCLF for the planning, design and con- <br />struction of the Wastewater Facilities; and <br />WHEREAS, the Ohio WPCLF requires legislative authority to apply for a loan and the <br />execution of an agreement as well as designating dedicated repayment source; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thuds of its members determines that this reso- <br />lution is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments in that the City wishes to secure financing for the <br />2019 Wastewater Facilities Project immediately; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Mayor, Director of Public Works, Finance Director, Law Director or City En- <br />gineer to apply for, accept and enter into a Water Pollution Control Loan Fund ( "WPCLF ") <br />Agreement on behalf of the city for planning, design and construction of the High Rate Treat- <br />ment Facility Waste Water Treatment Plant Improvements Project ("Wastewater Facilities "). <br />Section 2. That the dedicated source of repayment will be WWTP Fund (511) <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action, were in meetings open to the public in compliance with all legal requirements. <br />Section 4. This resolution is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the preamble <br />to this resolution, and provided it receives the affirmative vote of at least two thirds of the mem- <br />
