Recommended for <br />adoption by COW 11/12/18 <br />Anderson, Bullock, George, Litten <br />O'Leary, O'Malley, Rader <br />RESOLUTION NO. 9036-18 BY: <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force after the <br />earliest period allowed by law, authorizing the Mayor to enter into a lease agreement with The <br />Cleveland Clinic Foundation for the lease of the real property located at 1450 Belle Avenue, <br />Suite 200, also known as the Community Health Center. <br />WHEREAS, the City is the owner of real property located at 1450 Belle Avenue, known <br />as the Community Health Center; and <br />WHEREAS, Suite 200 of that property is currently occupied subject to a long -term lease <br />for that suite, which expires December 31, 2018; and <br />WHEREAS, this Council has determined it is in the best interest of the City to renew its <br />leasehold relationship with the Cleveland Clinic Foundation to further the interest of the City and <br />its residents; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the city of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this reso- <br />lution is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public peace, property, health and safety, and to provide for <br />the usual daily operation of municipal departments in that the lease governing this suite expires <br />December 31, 2018; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor is hereby authorized, on behalf of the City, to enter into a lease <br />agreement with The Cleveland Clinic Foundation for the lease of the real property located at <br />1450 Belle Avenue, Ste. 200, also known as the Community Health Center, in substantially the <br />same form as Exhibit A. <br />Section 2. All provisions of the Codified Ordinances with respect to the sale or lease of <br />City -owned property are deeded to have been met or superseded by this ordinance inasmuch as <br />those provisions apply to the lease of real property contemplated in the agreement. <br />Section 3. To the extent that this resolution is inconsistent with any other ordinance or <br />resolution previously adapted by Council with respect to the purchase of property by the city or <br />the sale or lease of property owned by the City, this ordinance is meant to and shall supersede <br />such previously- adopted legislation. <br />
