ORDINANCE NO. 4 -18 — AN ORDINANCE to take effect <br />immediately provided it receives the affirmative vote of at least two <br />thirds of the members of Council to adopt 128.22 through 128.2215 of <br />the Codified Ordinances as mandated by the state legislature to authorize <br />state officials to collect and administer municipal net profit taxes. <br />(REFERRED TO THE FINANCE COMMITTEE 2/5/18) (Pg. 14) <br />Motion by Mr. O'Leary, seconded by Mr. Anderson, to substitute Ordinance 4- <br />18. <br />Law Director Butler was called upon to explain the necessity for adoption that <br />night. <br />Mr. Butler indicated the Ordinance enacts new provisions of the tax code in the <br />City of Lakewood's Codified Ordinances. Tax Code provisions that would be <br />added to our existing tax Code for the State's passage of HB 49 which is just a <br />general 2 -year budget bill. House Bill 49 permitted among many, many other <br />things businesses to elect to file their net profits tax returns with the State rather <br />than with the local municipality; something to which over 120 municipalities in <br />Ohio have objected by way of filing a lawsuit against the State. Lakewood is <br />one of those municipalities. <br />The lawsuit is an effort to preserve Lakewood's and other municipalities home <br />rule authority to enact tax provisions that don't run afoul of the Constitution. <br />We believe there's good reasons why the Judge, hearing that lawsuit, filed by <br />all parties in the same Court in Columbus will return these particular provisions <br />of the State Law. <br />The Judge so far has so far put a stay on the effectiveness of those particular tax <br />provisions of HB 49. He is expect, we're told, by our attorneys, to rule as early <br />as this week. <br />G <br />
