Councilman Bullock stated for the record that average response time is 3 minutes and 35 <br />seconds, which was confirmed by Chief Malley. <br />ORDINANCE 05-19 <br />-AN ORDINANCE to take effect at the earliest period allowed by law <br />enacting Section 331.346, Using Mobile Telephones while Driving, of the Codified Ordinances <br />of the City of Lakewood in order to update the Code so as to regulate the use of mobile phones <br />while driving in the City. (Placed on 1st reading and referred to Public Safety 1/22/19; 2nd <br />reading 2/4/19) <br />ORDINANCE 06-19 <br />-AN ORDINANCE to take effect immediately provided it receives the <br />affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and <br />bein force after the earliest period allowed by law, repealing Section 549.051, Sale, Possession <br />and use of Stun Guns, of the Codified Ordinances of the City of Lakewood as this section is no <br />longer enforceable. (Placed on 1st reading and referred to PublicSafety 2/4/19; 2nd reading <br />2/19/19) <br />Director Butlergave an overview of changes to Ordinances 5-19. He stated that the new version <br />is an effort to include the proposal with a section of code that precedes Section 345, which <br />already bans texting while driving. The new version of Ord.5-19broadensthe definition of <br />communications devices to avoid a conflict in the code if mobile telephones are only included. <br />This version bans the use of handheld devices while driving,permitting Bluetooth use and <br />hands-free methods of communication. The portions of the legislation in red are mere additions <br />and lines in red and bold-face are things that would change in the existing ban on texting while <br />driving ordinance. <br />In regard to Ordinance 6-19, Director Butler indicated that the US Supreme Court determined <br />nd <br />that a Massachusetts law banning stun guns was unconstitutional and violated the2 <br />Amendment.This required Lakewood to repeal its law concerning a ban on stun guns. At a past <br />regular meeting of City Council,Council President OLeary requested from the floor a way to <br />continue to regulatethem. Ordinance 6-19, as revised, would includestun guns in a section of <br />code where other weapons are regulated lawfully.Councilman Bullock asked if Ordinance 6-19 <br />nd <br />is in violation of the 2Amendment.Butler responded that state code does not prohibit <br />municipalitiesfrom adoptingthe regulation of firearms and that the city has leeway to regulate <br />the use of firearms or weapons. <br />The meeting was adjourned at 7:03p.m. <br /> <br />
