(a) No person shall discharge any air gun, rifle, shotgun, revolver, pistol or other <br />firearm or stun gun within the corporate limits of the Municipality. <br />(b) This section does not apply wben firearms or stun guns are used in self de- <br />fense, in the discharge of official duty or when otherwise lawfully authorized. <br />(c) Whoever violates this section is guilty of a misdemeanor of the fourth de- <br />gree. <br />Section 8. Section 549.27, Failure to Secure Weapons; Minors and Incompetent Persons, <br />of the Codified Ordinances of the City of Lakewood, currently reading as follows: <br />549.27 FAILURE TO SECURE WEAPONS; MINORS AND INCOMPETENT <br />PERSONS. <br />(a) All firearms and deadly weapons must be secured in a manner which pro- <br />hibits the accessibility, acquisition and/or use of such item by any minor or in- <br />competent person. <br />(b) Firearms furnished to a person under age eighteen (18) must be in accord- <br />ance with Ohio Revised Code Section 2923.21. <br />(c) Any person who owns or possesses a firearm and/or deadly weapon and fails <br />to comply with paragraph (a) is guilty of a misdemeanor of the first degree. <br />is hereby repealed, and new Section 549.27, Failure to Secure Weapons; Minors and Incompetent <br />Persons, of the Codified Ordinances of the City of Lakewood is hereby enacted to read as follows: <br />549.27 FAILURE TO SECURE WEAPONS; MINORS AND INCOMPETENT <br />PERSONS. <br />(a) All firearms, stun guns and deadly weapons must be secured in a manner <br />which prohibits the - accessibility, acquisition and /or use of such item by any minor <br />or incompetent person. <br />(b) Firearms furnished to a person under age eighteen (18) must be in accord- <br />ance with Ohio Revised Code Section 2923.21. <br />(c) Any person who owns or possesses a firearm, stun gun and/or deadly <br />weapon and fails to comply with paragraph (a) is guilty of a misdemeanor of the <br />first degree. <br />Section 9. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this ordinance were passed in an open meeting of this Council and that <br />all deliberations of this Council and any of its committees that resulted in such actions were in <br />meetings open to the public and in compliance with legal requirements. <br />Section 10. This ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City and <br />for the usual daily operation of the City for the reasons set forth and defined in the preamble to <br />this ordinance, and provided it receives the affirmative vote of at least two thirds of the members <br />of Council, this ordinance shall take effect and be in force immediately upon its adoption by the <br />Council and approval by the Mayor, or otherwise it shall take effect and be in force after the earliest <br />period allowed by law. <br />
